Mais quelles sont celles \u00e0 inviter lorsque les n\u00e9gociations ont pour objet d\u2019\u00e9tendre le p\u00e9rim\u00e8tre d\u2019une Unit\u00e9 \u00e9conomique et sociale (UES) ? Celles qui sont repr\u00e9sentatives dans chaque entit\u00e9 ou celles repr\u00e9sentatives dans l\u2019UES d\u2019origine ? R\u00e9ponse du juge\u2026<\/p>\n<h2>Modification du p\u00e9rim\u00e8tre d\u2019une UES : qui doit n\u00e9gocier ?<\/h2>\n<p>Pour m\u00e9moire, la n\u00e9gociation et la signature d\u2019un accord collectif sont des pr\u00e9rogatives r\u00e9serv\u00e9es aux organisations syndicales repr\u00e9sentatives.<\/p>\n<p>Pour \u00eatre reconnue comme telle, l\u2019organisation syndicale doit notamment avoir obtenu au moins 10 % des suffrages exprim\u00e9s au 1er tour des derni\u00e8res \u00e9lections professionnelles\u2026<\/p>\n<p>Dans une r\u00e9cente affaire, \u00e0 la suite de l\u2019acquisition d\u2019un groupe de soci\u00e9t\u00e9s par une Unit\u00e9 \u00e9conomique et sociale (UES), il est envisag\u00e9 l\u2019extension du p\u00e9rim\u00e8tre de l\u2019UES pour y int\u00e9grer les entit\u00e9s du groupe nouvellement acquis.<\/p>\n<p>Cette extension doit prendre la forme d\u2019un accord collectif\u2026 n\u00e9cessitant des n\u00e9gociations pr\u00e9alables. Pour ce faire, l\u2019UES charg\u00e9e de piloter la n\u00e9gociation doit inviter l\u2019ensemble des syndicats repr\u00e9sentatifs habilit\u00e9s \u00e0 y participer.<\/p>\n<p>Et c\u2019est l\u00e0 le n\u0153ud du probl\u00e8me !<\/p>\n<p>Pour identifier et inviter ces syndicats, l\u2019UES a pris en compte, pour chacun, l\u2019ensemble des suffrages obtenus au sein de l\u2019UES et du groupe nouvellement acquis.<\/p>\n<p>Une organisation syndicale, qui n\u2019a pas \u00e9t\u00e9 invit\u00e9e \u00e0 la table des n\u00e9gociations, consid\u00e8re \u00eatre l\u00e9s\u00e9e par ce calcul : si elle a obtenu 12,34 % des suffrages au sein de l\u2019UES, ce score est de 8,73 % si on prend en compte le score dans les entit\u00e9s du groupe de soci\u00e9t\u00e9s nouvellement acquis.<\/p>\n<p>Mais l\u2019employeur ne comprend pas bien le probl\u00e8me : parce que l\u2019accord envisageant l\u2019extension d\u2019une UES est un accord interentreprises, les organisations syndicales habilit\u00e9es \u00e0 n\u00e9gocier doivent \u00eatre repr\u00e9sentatives dans l\u2019ensemble des entit\u00e9s concern\u00e9es\u2026 ce qui n\u2019\u00e9tait pas le cas pour cette organisation.<\/p>\n<p>L\u2019employeur n\u2019avait donc pas \u00e0 inviter ce syndicat \u00e0 n\u00e9gocier !<\/p>\n<p>Ce que r\u00e9fute le syndicat : selon lui, l\u2019accord n\u00e9goci\u00e9 est un accord UES et non un accord interentreprises.<\/p>\n<p>Dans cette hypoth\u00e8se, parce que le syndicat est repr\u00e9sentatif au sein de l\u2019UES d\u2019origine, cela suffit \u00e0 consid\u00e9rer qu\u2019il remplit le crit\u00e8re d\u2019audience n\u00e9cessaire \u00e0 sa repr\u00e9sentativit\u00e9. L\u2019employeur ne peut pas lui opposer son score dans les entit\u00e9s du groupe acquis pour l\u2019exclure des n\u00e9gociations\u2026<\/p>\n<p>Ce qui emporte la conviction du juge, qui tranche en faveur de l\u2019organisation syndicale sur ce point !<\/p>\n<p>L\u2019accord collectif portait ici reconnaissance d\u2019une UES : il ne peut donc pas \u00eatre assimil\u00e9 \u00e0 un accord interentreprises.
