Lesquelles ? Comment doivent-elles \u00eatre communiqu\u00e9es ? R\u00e9ponses.<\/p>\n<h2>Des informations \u00e0 communiquer dans un d\u00e9lai de 7 jours\u2026<\/h2>\n<p>L\u2019employeur communique individuellement aux gens de mer, au plus tard le 7e jour \u00e0 compter de la date d\u2019embauche, les informations suivantes :<\/p>\n<ul>\n<li>la date d&#8217;embauche ;<\/li>\n<li>le cas \u00e9ch\u00e9ant, la dur\u00e9e et les conditions de la p\u00e9riode d&#8217;essai ;<\/li>\n<li>la p\u00e9riodicit\u00e9 et la m\u00e9thode de versement du salaire et de ses accessoires ;<\/li>\n<li>pour les gens de mer travaillant \u00e0 bord des navires autres que de p\u00eache, le nom et le num\u00e9ro d&#8217;immatriculation du ou des navires \u00e0 bord desquels ils s&#8217;engagent \u00e0 travailler ;<\/li>\n<li>la dur\u00e9e de travail quotidienne, hebdomadaire ou mensuelle, ou ses modalit\u00e9s d&#8217;am\u00e9nagement sur une autre p\u00e9riode de r\u00e9f\u00e9rence, les conditions dans lesquelles ils peuvent \u00eatre conduit \u00e0 effectuer des heures suppl\u00e9mentaires ou compl\u00e9mentaires, ainsi que, le cas \u00e9ch\u00e9ant, toute modalit\u00e9 concernant les changements d&#8217;\u00e9quipe en cas d&#8217;organisation du travail en \u00e9quipes successives alternantes. Notez que ces informations ne sont pas \u00e0 communiquer aux gens de mer dont la dur\u00e9e du travail est fix\u00e9e par accord national professionnel ou accord de branche \u00e9tendu.<\/li>\n<\/ul>\n<h2>\u2026 d\u2019autres informations \u00e0 communiquer dans un d\u00e9lai d\u2019un mois<\/h2>\n<p>L\u2019employeur communique individuellement aux gens de mer, au plus tard un mois \u00e0 compter de la date d\u2019embauche, les informations suivantes :<\/p>\n<ul>\n<li>le droit \u00e0 la formation assur\u00e9 par l&#8217;employeur ;<\/li>\n<li>la proc\u00e9dure \u00e0 observer par l&#8217;employeur et le nouvel embauch\u00e9 en cas de cessation de leur relation de travail.<\/li>\n<\/ul>\n<h2>Les modalit\u00e9s de communication<\/h2>\n<p>La communication de certaines informations peut prendre la forme d\u2019un renvoi aux dispositions l\u00e9gislatives et r\u00e8glementaires ou aux stipulations conventionnelles applicables.<\/p>\n<p>Il s\u2019agit des informations concernant la dur\u00e9e et les conditions de la p\u00e9riode d\u2019essai, le droit \u00e0 la formation, la proc\u00e9dure en cas de cessation de la relation de travail, la p\u00e9riodicit\u00e9 et la m\u00e9thode de versement du salaire et de ses accessoires, et la dur\u00e9e du travail.<\/p>\n<p>En pratique, l\u2019ensemble des informations (\u00e0 communiquer sous 7 jours ou 1 mois) doivent \u00eatre adress\u00e9es par l\u2019employeur par tout moyen conf\u00e9rant date certaine, sous format \u00e9lectronique ou papier.<\/p>\n<p>Si le format \u00e9lectronique est utilis\u00e9, les modalit\u00e9s suivantes doivent \u00eatre respect\u00e9es :<\/p>\n<ul>\n<li>le salari\u00e9 dispose d&#8217;un moyen d&#8217;acc\u00e9der \u00e0 cette information \u00ab \u00e9lectronique \u00bb ;<\/li>\n<li>les informations peuvent \u00eatre enregistr\u00e9es et imprim\u00e9es ;<\/li>\n<li>l&#8217;employeur conserve un justificatif de la transmission ou de la r\u00e9ception de ces informations.<\/li>\n<\/ul>\n<div>Sources :  <\/p>\n<ul>\n<li><a href=\"https:\/\/www.legifrance.gouv.fr\/jorf\/id\/JORFTEXT000048284124\" rel=\"noopener\" target=\"_blank\">D\u00e9cret n\u00b0 2023-1004 du 30 octobre 2023 portant transposition de la directive (UE) 2019\/1152 du Parlement europ\u00e9en et du Conseil du 20 juin 2019 relative \u00e0 des conditions de travail transparentes et pr\u00e9visibles dans l&#8217;Union europ\u00e9enne<\/a><\/li>\n<\/ul>\n<\/div>\n<p><a href=\"https:\/\/www.weblex.fr\/weblex-actualite\/embauche-des-gens-de-mer-obligation-d-information-renforcee-pour-l-employeur\" target=\"_blank\" rel=\"noopener\">Embauche des gens de mer : obligation d\u2019information renforc\u00e9e pour l\u2019employeur<\/a> &#8211; \u00a9 Copyright WebLex<\/p>\n<p><img decoding=\"async\" src=\"https:\/\/www.weblex.fr\/sites\/default\/files\/actualites\/images\/navire.jpg\"><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Depuis le 1er novembre 2023, l\u2019employeur doit communiquer un certain nombre d\u2019informations aux gens de mer nouvellement embauch\u00e9s.
