Lesquelles ?<\/p>\n<h2>Focus sur les informations \u00e0 transmettre au salari\u00e9 lors de l\u2019embauche<\/h2>\n<p>Depuis le 1er novembre 2023, l\u2019employeur est tenu de communiquer un certain nombre de nouvelles informations au salari\u00e9 nouvellement embauch\u00e9.<\/p>\n<p>Notez que la nature des informations communiqu\u00e9es diff\u00e8re en fonction de l\u2019anciennet\u00e9 du salari\u00e9.<\/p>\n<p>Ainsi, au plus tard au 7e jour apr\u00e8s son arriv\u00e9e, le salari\u00e9 doit conna\u00eetre les informations suivantes :<\/p>\n<ul>\n<li>l\u2019identit\u00e9 des parties \u00e0 la relation de travail ;<\/li>\n<li>le ou les lieux de travail et, si elle est distincte, l\u2019adresse de l\u2019employeur ;<\/li>\n<li>l\u2019intitul\u00e9 du poste, les fonctions, la cat\u00e9gorie socioprofessionnelle ou la cat\u00e9gorie d\u2019emploi ;<\/li>\n<li>si le contrat est un CDD, la date de fin pr\u00e9vue ou la dur\u00e9e pr\u00e9vue de celui-ci ;<\/li>\n<li>le cas \u00e9ch\u00e9ant, la dur\u00e9e et les conditions de la p\u00e9riode d\u2019essai ;<\/li>\n<li>les \u00e9l\u00e9ments constitutifs de la r\u00e9mun\u00e9ration indiqu\u00e9s s\u00e9par\u00e9ment, y compris les majorations pour les heures suppl\u00e9mentaires, ainsi que la p\u00e9riodicit\u00e9 et les modalit\u00e9s de paiement ;<\/li>\n<li>la dur\u00e9e de travail quotidienne, hebdomadaire, mensuelle ou ses modalit\u00e9s d\u2019am\u00e9nagement sur une autre p\u00e9riode de r\u00e9f\u00e9rence, les conditions dans lesquelles le salari\u00e9 peut \u00eatre conduit \u00e0 effectuer des heures suppl\u00e9mentaires ou compl\u00e9mentaires ainsi que, le cas \u00e9ch\u00e9ant, toute modalit\u00e9 concernant les changements d\u2019\u00e9quipe en cas d\u2019organisation du travail en \u00e9quipes successives alternantes.<\/li>\n<\/ul>\n<p>Au plus tard 1 mois \u00e0 compter de la date d\u2019embauche, le salari\u00e9 doit conna\u00eetre les informations suivantes :<\/p>\n<ul>\n<li>pour les salari\u00e9s int\u00e9rimaires : l\u2019identit\u00e9 de l\u2019entreprise utilisatrice d\u00e8s qu\u2019elle est connue ;<\/li>\n<li>le droit \u00e0 la formation assur\u00e9 par l\u2019employeur ;<\/li>\n<li>la dur\u00e9e du cong\u00e9 pay\u00e9 auquel le salari\u00e9 a droit, ou les modalit\u00e9s de calcul de cette dur\u00e9e ;<\/li>\n<li>la proc\u00e9dure \u00e0 mettre en \u0153uvre par l\u2019employeur et le salari\u00e9 en cas de cessation de la relation de travail ;<\/li>\n<li>les conventions collectives et accords collectifs applicables dans l\u2019entreprise ;<\/li>\n<li>les r\u00e9gimes obligatoires auxquels le salari\u00e9 est affili\u00e9, la mention des contrats de protection sociale compl\u00e9mentaire dont les salari\u00e9s b\u00e9n\u00e9ficient collectivement en application d\u2019un accord collectif ou d\u2019une d\u00e9cision unilat\u00e9rale de l\u2019employeur et, le cas \u00e9ch\u00e9ant, les conditions d\u2019anciennet\u00e9 qui y sont attach\u00e9es.<\/li>\n<\/ul>\n<p>\u00c0 noter que ces informations peuvent \u00eatre transmises par tout moyen permettant de les dater pr\u00e9cis\u00e9ment, que ce soit sous format \u00e9lectronique ou papier.<\/p>\n<div>Sources :  <\/p>\n<ul>\n<li><a href=\"https:\/\/www.legifrance.gouv.fr\/jorf\/id\/JORFTEXT000048284124\" rel=\"noopener\" target=\"_blank\">D\u00e9cret no 2023-1004 du 30 octobre 2023 portant transposition de la directive (UE) 2019\/1152 du Parlement europ\u00e9en et du Conseil du 20 juin 2019 relative \u00e0 des conditions de travail transparentes et pr\u00e9visibles dans l\u2019Union europ\u00e9enne&nbsp;<\/a><\/li>\n<li><a href=\"https:\/\/entreprendre.service-public.fr\/actualites\/A16885\" rel=\"noopener\" target=\"_blank\">Actualit\u00e9 entreprendre.service-public.fr du 7 novembre 2023 : \u00ab De nouvelles obligations d\u2019information pour l\u2019employeur \u00bb<\/a><\/li>\n<\/ul>\n<\/div>\n<p><a href=\"https:\/\/www.weblex.fr\/weblex-actualite\/embauche-obligation-d-information-renforcee-pour-l-employeur\" target=\"_blank\" rel=\"noopener\">Embauche : obligation d\u2019information renforc\u00e9e pour l\u2019employeur<\/a> &#8211; \u00a9 Copyright WebLex<\/p>\n<p><img decoding=\"async\" src=\"https:\/\/www.weblex.fr\/sites\/default\/files\/actualites\/images\/embaucheinfo.jpg\"><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Depuis le 1er novembre 2023, l\u2019employeur doit communiquer de nouvelles informations au salari\u00e9 nouvellement embauch\u00e9.
