R\u00e9ponse du juge.&nbsp;<\/p>\n<h2>L\u2019employeur doit mentionner la possibilit\u00e9 d\u2019un accompagnement ext\u00e9rieur !<\/h2>\n<p>Un repr\u00e9sentant du personnel est convoqu\u00e9 par son employeur \u00e0 un entretien pr\u00e9alable. Mais puisqu\u2019il est le seul repr\u00e9sentant du personnel de l\u2019entreprise, l\u2019employeur se contente de mentionner la possibilit\u00e9 d\u2019accompagnement \u00e0 cet entretien par un salari\u00e9 faisant partie de l\u2019entreprise\u2026<\/p>\n<p>\u00ab Insuffisant \u00bb, pour l\u2019\u00e9lu : l\u2019employeur aurait d\u00fb mentionner dans la lettre de convocation la possibilit\u00e9 de se faire accompagner par un conseiller du salari\u00e9, personne ext\u00e9rieure \u00e0 l\u2019entreprise.&nbsp;<\/p>\n<p>\u00ab Non ! \u00bb, se d\u00e9fend l\u2019employeur : cette possibilit\u00e9 d\u2019accompagnement par un conseiller ext\u00e9rieur n\u2019existe que lorsqu\u2019il n\u2019y a pas d\u2019institutions repr\u00e9sentatives du personnel dans l\u2019entreprise.
