rural : une r\u00e9siliation toujours possible ?"},"content":{"rendered":"<p>Un propri\u00e9taire peut demander la r\u00e9siliation d\u2019un bail rural en cas de cession illicite du bail par le locataire ou de d\u00e9faut d\u2019exploitation effective par le locataire, sous r\u00e9serve dans ce dernier cas, de justifier d\u2019un pr\u00e9judice. \u00c9tude de cas\u2026<\/p>\n<h2>R\u00e9siliation d\u2019un bail rural : cas v\u00e9cu d\u2019un locataire qui prend sa retraite\u2026<\/h2>\n<p>Le locataire de parcelles agricoles d\u00e9cide de les mettre \u00e0 disposition de l\u2019exploitation agricole \u00e0 responsabilit\u00e9 limit\u00e9e (EARL) dont il est associ\u00e9.<\/p>\n<p>En raison de diff\u00e9rends entre le locataire et la propri\u00e9taire, un juge est saisi du litige, au cours duquel la propri\u00e9taire en profite pour demander la r\u00e9siliation du bail : il y aurait, selon elle, une cession illicite du bail \u00e0 un tiers.<\/p>\n<p>Selon elle, en effet, la loi permet de demander la r\u00e9siliation du bail en cas de cession illicite par le locataire, qui est caract\u00e9ris\u00e9e ici par l\u2019arr\u00eat de l\u2019exploitation effective et permanente des parcelles, le locataire \u00e9tant \u00e0 la retraite !<\/p>\n<p>\u00ab Une r\u00e9siliation impossible ! \u00bb, conteste le locataire, pour qui la propri\u00e9taire ne justifie d\u2019aucun pr\u00e9judice.<\/p>\n<p>Qu\u2019en pense le juge ?<\/p>\n<p>Il rappelle :<\/p>\n<ul>\n<li>d\u2019abord, que, par principe, toute cession de bail est interdite, sauf si elle est consentie, avec l\u2019agr\u00e9ment du propri\u00e9taire, au profit du conjoint ou du partenaire d&#8217;un pacte civil de solidarit\u00e9 du locataire participant \u00e0 l&#8217;exploitation ou aux descendants du locataire ;<\/li>\n<li>ensuite, que le locataire associ\u00e9 d\u2019une soci\u00e9t\u00e9 \u00e0 objet principalement agricole qui met \u00e0 la disposition de celle-ci tout ou partie des biens lou\u00e9s doit, \u00e0 peine de r\u00e9siliation, continuer \u00e0 se consacrer \u00e0 l&#8217;exploitation du bien lou\u00e9 mis \u00e0 disposition, en participant sur les lieux aux travaux de fa\u00e7on effective et permanente, selon les usages de la r\u00e9gion et en fonction de l&#8217;importance de l&#8217;exploitation ;<\/li>\n<li>enfin, que le propri\u00e9taire peut demander la r\u00e9siliation du bail s&#8217;il justifie soit :\n<ul>\n<li>d\u2019une cession illicite ;<\/li>\n<li>d\u2019un d\u00e9faut d\u2019exploitation effective par le locataire, mais seulement si cela est de nature \u00e0 lui porter pr\u00e9judice.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p>Pour en revenir au cas qui lui est soumis, le juge pr\u00e9cise que le locataire qui, apr\u00e8s avoir mis le bien lou\u00e9 \u00e0 la disposition d&#8217;une soci\u00e9t\u00e9, ne participe plus aux travaux de fa\u00e7on effective et permanente selon les usages de la r\u00e9gion et en fonction de l&#8217;importance de l&#8217;exploitation, abandonne la jouissance du bien lou\u00e9 \u00e0 cette soci\u00e9t\u00e9 et proc\u00e8de \u00e0 une cession illicite du droit au bail.<\/p>\n<p>Dans ce cas, la propri\u00e9taire n\u2019a pas \u00e0 prouver qu\u2019elle a subi un quelconque pr\u00e9judice et la demande de r\u00e9siliation doit donc \u00eatre accueillie
