R\u00e9ponse du juge.<\/p>\n<h2>Ordre du jour du CSE : quand les \u00e9lus pensent avoir trouv\u00e9 la faille\u2026<\/h2>\n<p>Un employeur est condamn\u00e9 pour avoir reformul\u00e9 lors de l\u2019\u00e9laboration de l\u2019ordre du jour d\u2019une r\u00e9union du CSE d\u2019\u00e9tablissement (CSEE) une question pr\u00e9alablement transmise par les \u00e9lus.<\/p>\n<p>Pour eux, cette reformulation constitue une atteinte \u00e0 leur libert\u00e9 d\u2019expression et n\u2019est permise que lorsqu\u2019elle concerne l\u2019une des attributions de la commission sant\u00e9, s\u00e9curit\u00e9 et conditions de travail (CSSCT)\u2026 Ce qui n\u2019est pas le cas ici.<\/p>\n<p>L\u2019employeur \u00e9tait donc oblig\u00e9 de retranscrire fid\u00e8lement et sans aucune reformulation, anonymisation ou regroupement les questions adress\u00e9es par les membres, ce qu\u2019il n\u2019a manifestement pas fait !<\/p>\n<p>Une condamnation que l\u2019employeur s\u2019empresse de contester. Pour lui, le r\u00e8glement int\u00e9rieur du CSEE pr\u00e9voit une \u00e9laboration conjointe de l\u2019ordre du jour entre les membres de l\u2019instance (repr\u00e9sent\u00e9s par la secr\u00e9taire du CSEE) et la direction de l\u2019entreprise.<\/p>\n<p>Le caract\u00e8re conjoint de cette \u00e9laboration doit permettre \u00e0 l\u2019employeur, pr\u00e9sident de l\u2019instance, de reformuler librement une question pos\u00e9e !<\/p>\n<p>\u00ab Tout \u00e0 fait ! \u00bb, confirme le juge : l\u2019ordre du jour est \u00e9tabli et sign\u00e9 conjointement par la direction et par la secr\u00e9taire, membre de la repr\u00e9sentation du personnel du CSEE.
