Des enregistrements qui peuvent justifier une sanction disciplinaire ? Pas si s\u00fbr\u2026<\/p>\n<h2>Vid\u00e9osurveillance dans l\u2019entreprise : attention \u00e0 la finalit\u00e9 poursuivie !<\/h2>\n<p>Un employeur met en place une vid\u00e9osurveillance des entrep\u00f4ts de sa soci\u00e9t\u00e9, le but \u00e9tant d\u2019assurer la s\u00e9curit\u00e9 de son personnel et de ses biens.<\/p>\n<p>Quelque temps plus tard, gr\u00e2ce \u00e0 ces enregistrements vid\u00e9o, il d\u00e9couvre qu\u2019un salari\u00e9 a fum\u00e9 dans un local de repos o\u00f9 cela est interdit pour des raisons de s\u00e9curit\u00e9. Un local dans lequel il est d\u2019ailleurs rest\u00e9 pr\u00e8s d\u2019une heure\u2026<\/p>\n<p>Une situation inacceptable, pour l\u2019employeur, qui prononce une mise \u00e0 pied disciplinaire de 2 semaines \u00e0 l\u2019\u00e9gard de ce salari\u00e9.<\/p>\n<p>Ce que ce dernier conteste, r\u00e9clamant \u00e9galement un rappel de salaire correspondant \u00e0 la p\u00e9riode couverte par la mise \u00e0 pied.<\/p>\n<p>Le salari\u00e9 estime, en effet, que la preuve obtenue par la vid\u00e9osurveillance est illicite et ne peut donc pas \u00eatre utilis\u00e9e par l\u2019employeur pour justifier la sanction disciplinaire appliqu\u00e9e. Pourquoi ? Parce que l\u2019employeur ne peut pas utiliser un proc\u00e9d\u00e9 de vid\u00e9osurveillance pour un objectif autre que celui pour lequel il l\u2019a d\u00e9clar\u00e9.<\/p>\n<p>Or la finalit\u00e9 de la vid\u00e9osurveillance \u00e9tait ici d\u2019assurer la s\u00e9curit\u00e9 du personnel et des biens\u2026 pas de surveiller le personnel et de contr\u00f4ler les horaires de travail !<\/p>\n<p>\u00ab Au contraire ! \u00bb r\u00e9torque l\u2019employeur, qui rappelle qu\u2019il est libre de mettre en place des proc\u00e9d\u00e9s de surveillance des entrep\u00f4ts ou d\u2019autres locaux dans lesquels les salari\u00e9s ne travaillent pas ou n&#8217;exercent pas leurs fonctions, sans avoir \u00e0 les en informer, puisqu&#8217;ils ne visent pas \u00e0 contr\u00f4ler leur activit\u00e9.<\/p>\n<p>Il n\u2019a donc rien \u00e0 se reprocher, et la sanction disciplinaire prononc\u00e9e est parfaitement justifi\u00e9e.<\/p>\n<p>\u00ab Non ! \u00bb, tranche le juge, qui donne raison au salari\u00e9.
