Mais il peut arriver que cette situation cause un pr\u00e9judice au vendeur, notamment lorsque le titulaire du droit change d\u2019avis\u2026 Illustration.<\/p>\n<h2>Droit de pr\u00e9emption urbain : quand la commune change d\u2019avis\u2026<\/h2>\n<p>En vue de l\u2019achat d\u2019un appartement et de trois caves, des particuliers signent un compromis, le montant de la transaction finale \u00e9tant fix\u00e9e \u00e0 200 000 \u20ac. Quelques semaines plus tard, la commune d\u00e9cide d\u2019exercer son droit de pr\u00e9emption urbain (DPU) et propose une somme de 140 000 \u20ac. Face \u00e0 cette proposition, le vendeur renonce \u00e0 toute transaction\u2026<\/p>\n<p>Pour m\u00e9moire, le DPU permet \u00e0 certains organismes publics, comme l\u2019\u00c9tat ou une commune, de se porter acqu\u00e9reur du bien en vente, en lieu et place de l\u2019acheteur choisi par le vendeur, toutes conditions par ailleurs remplies.<\/p>\n<p>\u00c0 la suite de l\u2019abandon de son projet, le vendeur remet finalement en vente le bien, puis trouve un accord avec les acqu\u00e9reurs initiaux, pour un montant de 160 000 \u20ac\u2026 sans que cette fois-ci la commune ne manifeste un quelconque int\u00e9r\u00eat pour la transaction.<\/p>\n<p>Estimant avoir \u00e9t\u00e9 l\u00e9s\u00e9 \u00e0 hauteur de la diff\u00e9rence entre le prix de vente initial et le prix final, soit 40 000 \u20ac, le vendeur demande une indemnisation \u00e0 la commune \u00e0 hauteur de cette diff\u00e9rence.<\/p>\n<p>Selon le vendeur, en effet, le droit de pr\u00e9emption ne peut \u00eatre exerc\u00e9 que si le titulaire du droit :<\/p>\n<ul>\n<li>justifie de la r\u00e9alit\u00e9 d&#8217;un projet d&#8217;action ou d&#8217;op\u00e9ration d&#8217;am\u00e9nagement \u00e0 la date \u00e0 laquelle il est exerc\u00e9 (alors m\u00eame que les caract\u00e9ristiques pr\u00e9cises de ce projet n&#8217;auraient pas \u00e9t\u00e9 d\u00e9finies \u00e0 cette date) ;<\/li>\n<li>fait appara\u00eetre la nature de ce projet dans la d\u00e9cision de pr\u00e9emption ;<\/li>\n<li>justifie du fait que le projet r\u00e9pond \u00e0 un int\u00e9r\u00eat g\u00e9n\u00e9ral suffisant.<\/li>\n<\/ul>\n<p>Ce qui n\u2019est pas le cas, selon lui\u2026<\/p>\n<p>Ce qui est le cas, selon la commune, qui rappelle, entre autres, que la d\u00e9cision de pr\u00e9emption est fond\u00e9e sur les orientations d\u2019un programme local d&#8217;habitat communautaire et sur la d\u00e9lib\u00e9ration du conseil de territoire instituant le droit de pr\u00e9emption urbain territorial sur le territoire de la commune.<\/p>\n<p>Ce qui ne convainc pas le juge : si la d\u00e9cision de pr\u00e9emption litigieuse se fondait certes sur les orientations du programme local d&#8217;habitat communautaire, elle n\u2019\u00e9tait assise toutefois que sur des consid\u00e9rations g\u00e9n\u00e9rales\u2026 Ce qui ne permet pas, selon lui, de d\u00e9terminer la nature de l&#8217;action ou de l&#8217;op\u00e9ration d&#8217;am\u00e9nagement que la commune entendait mener en exer\u00e7ant son droit de pr\u00e9emption.<\/p>\n<p>Par ailleurs, et en tout \u00e9tat de cause constate le juge, la commune ne prouve pas qu\u2019elle ait jamais eu de projet et entendu participer \u00e0 la politique locale de l\u2019habitat.<\/p>\n<p>Enfin, il constate que la vente projet\u00e9e initialement pouvait probablement aboutir, les acheteurs ayant obtenu, \u00e0 l\u2019\u00e9poque, un financement bancaire.
