La raison ? La fen\u00eatre n\u2019est pas \u00e9quip\u00e9e d\u2019un garde-corps. Ce qui est normal, pour un immeuble ancien, rappelle le bailleur\u2026<\/p>\n<p>\u00ab C\u2019est anormal ! \u00bb, r\u00e9plique la locataire : selon elle, la r\u00e9glementation sur les logements d\u00e9cents impose justement aux bailleurs d\u2019installer des garde-corps sur les immeubles anciens qui n\u2019en sont pas \u00e9quip\u00e9s. Or, le bailleur n\u2019a jamais effectu\u00e9 les travaux ad\u00e9quats, ce qui constitue donc une faute, indemnisable selon elle. \u00ab Non ! \u00bb, r\u00e9pond le bailleur : pour lui, la r\u00e9glementation impose seulement d\u2019entretenir les garde-corps existants dans un \u00e9tat conforme \u00e0 leur usage, et non d\u2019en installer\u2026<\/p>\n<p>\u00ab Exact ! \u00bb, confirme le juge : le bailleur n\u2019est effectivement pas tenu d\u2019installer un garde-corps.
