Quelques temps plus tard, reprochant \u00e0 l\u2019employeur de ne pas respecter les r\u00e8gles applicables \u00e0 la dur\u00e9e maximale de travail, il lui r\u00e9clame une indemnisation\u2026 Que ce dernier refuse de payer, le salari\u00e9 n\u2019ayant finalement subi aucun \u00ab pr\u00e9judice \u00bb. \u00c0 tort ou \u00e0 raison ?<\/p>\n<div>\n<h2>Mi-temps th\u00e9rapeutique : cons\u00e9quences du non-respect de la dur\u00e9e maximale de travail<\/h2>\n<p>Par principe, lorsqu\u2019un salari\u00e9 saisit le juge d\u2019une demande d\u2019indemnisation, il doit prouver l\u2019existence d\u2019un pr\u00e9judice.<\/p>\n<p>Cependant, dans certaines hypoth\u00e8ses, par exemple en cas de d\u00e9passement de la dur\u00e9e maximale de travail, il est possible d\u2019obtenir une indemnisation d\u00e8s lors que la r\u00e8gle n\u2019est pas respect\u00e9e, sans avoir \u00e0 prouver de pr\u00e9judice.<\/p>\n<p>C\u2019est pr\u00e9cis\u00e9ment ce que le juge est venu rappeler dans une affaire r\u00e9cente.<\/p>\n<p>Un salari\u00e9 plac\u00e9 en arr\u00eat de travail pendant une ann\u00e9e, reprend le travail dans le cadre d\u2019un mi-temps th\u00e9rapeutique.
