Mais quel est le point de d\u00e9part de ce d\u00e9lai ? Une question \u00e0 laquelle le juge vient justement d\u2019apporter une r\u00e9ponse !<\/p>\n<div>\n<h2> Requalification d\u2019un CDD en CDI : 2 ans pour agir !<\/h2>\n<p>Un ancien salari\u00e9, embauch\u00e9 dans le cadre d\u2019un CDD de remplacement de 3 mois, r\u00e9clame la requalification de ce contrat en CDI au motif qu\u2019il ne mentionnait pas le nom et la qualification professionnelle de la personne remplac\u00e9e.<\/p>\n<p>\u00ab Sauf qu\u2019il avait 2 ans pour agir \u00e0 compter de la conclusion du CDD et que ce d\u00e9lai est d\u00e9pass\u00e9 ! \u00bb, souligne l\u2019employeur.<\/p>\n<p>\u00ab Non ! \u00bb, conteste le salari\u00e9 pour qui le point de d\u00e9part du d\u00e9lai de 2 ans correspond \u00e0 la date de fin du CDD\u2026 de sorte qu\u2019il est encore dans le d\u00e9lai pour agir.<\/p>\n<p>\u00ab Non ! \u00bb, tranche le juge : le point de d\u00e9part du d\u00e9lai de prescription de 2 ans commence \u00e0 courir \u00e0 compter de la date de conclusion du contrat de travail, et non \u00e0 compter de la date de fin du CDD.
