De quoi justifier, selon lui, la r\u00e9siliation de son contrat de travail\u2026<\/p>\n<div>\n<h2> R\u00e9mun\u00e9ration : libre fixation des objectifs sous conditions<\/h2>\n<p>Un salari\u00e9 conteste le plan de r\u00e9mun\u00e9ration variable que son employeur lui pr\u00e9sente pour l\u2019ann\u00e9e \u00e0 venir : il constate qu\u2019il y modifie le calcul de certaines primes, et qu\u2019il en supprime d\u2019autres. Selon lui, il s\u2019agit d\u2019une modification de sa r\u00e9mun\u00e9ration qui ne peut pas lui \u00eatre impos\u00e9e sans son accord.<\/p>\n<p>Cette modification justifie donc, toujours selon lui, la r\u00e9siliation de son contrat de travail aux torts de l\u2019employeur. Ce que ce dernier conteste consid\u00e9rant, quant \u00e0 lui, que le droit du salari\u00e9 \u00e0 sa r\u00e9mun\u00e9ration variable est inchang\u00e9 : la diff\u00e9rence des modalit\u00e9s de calcul des primes variables ne modifie pas la structure de sa r\u00e9mun\u00e9ration, leur nombre et leur nature restant constants.<\/p>\n<p>Et le juge lui donne raison : non seulement, la structure de la r\u00e9mun\u00e9ration des plans ant\u00e9rieurs n\u2019a pas \u00e9t\u00e9 modifi\u00e9e mais le contrat de travail pr\u00e9cise aussi que la d\u00e9termination des objectifs, qui conditionnent la r\u00e9mun\u00e9ration variable du salari\u00e9, rel\u00e8ve du pouvoir de direction de l&#8217;employeur.<\/p>\n<p>Il en conclut que l\u2019employeur, qui peut ici modifier unilat\u00e9ralement les objectifs assign\u00e9s au salari\u00e9, n\u2019a donc commis aucun manquement qui justifie la r\u00e9siliation du contrat de travail.
