Va-t-elle obtenir gain de cause ?<\/p>\n<div>\n<h2> Licenciement : proc\u00e9dure conventionnelle = garantie de fond ?<\/h2>\n<p>Un employeur licencie une salari\u00e9e pour faute grave.<\/p>\n<p>Un licenciement sans cause r\u00e9elle et s\u00e9rieuse, conteste la salari\u00e9e, l\u2019employeur n\u2019ayant pas respect\u00e9, selon elle, la proc\u00e9dure conventionnelle.<\/p>\n<p>Elle rappelle, en effet, que la convention collective qui s\u2019applique \u00e0 l\u2019entreprise pr\u00e9voit qu\u2019avant toute mesure disciplinaire, l\u2019employeur doit consulter un organisme tiers charg\u00e9 de donner son avis sur la mesure envisag\u00e9e\u2026 Ce qu\u2019il n\u2019a pas fait\u2026<\/p>\n<p>Pour rappel, dans le cadre d\u2019une proc\u00e9dure de licenciement pour motif disciplinaire, de nombreuses conventions collectives pr\u00e9voient des garanties suppl\u00e9mentaires allant au-del\u00e0 des garanties l\u00e9gales accord\u00e9es au salari\u00e9, appel\u00e9es \u00ab garanties de fond \u00bb.<\/p>\n<p>Dans cette affaire, l\u2019employeur n\u2019est pas du m\u00eame avis.
