Obtenir non seulement le paiement de son salaire mais aussi, diverses indemnit\u00e9s\u2026 Mais peut-il r\u00e9ellement obtenir gain de cause ?<\/p>\n<div>\n<h2> Prise d&#8217;acte de la rupture du contrat de travail : quid du non-paiement d&#8217;un mois de salaire ?<\/h2>\n<p>Pour rappel, la prise d\u2019acte de la rupture du contrat de travail est un mode de rupture \u00e0 l\u2019initiative du salari\u00e9 qui consid\u00e8re que son contrat de travail doit \u00eatre rompu en raison de manquements suffisamment graves de son employeur.<\/p>\n<p>A la suite de la prise d\u2019acte, le salari\u00e9 peut d\u00e9cider de saisir le juge pour obtenir la requalification de cette rupture en licenciement sans cause r\u00e9elle et s\u00e9rieuse\u2026 et donc, le paiement de diverses indemnit\u00e9s.<\/p>\n<p>Dans une r\u00e9cente affaire, un salari\u00e9 reproche \u00e0 son employeur de ne pas lui avoir pay\u00e9 son salaire du mois de mai. Il d\u00e9cide alors de prendre acte de la rupture de son contrat de travail en juin et, quelques mois plus tard, de saisir le juge pour demander la requalification de cette rupture en licenciement, et des indemnit\u00e9s.<\/p>\n<p>A tort, selon l\u2019employeur, qui consid\u00e8re :<\/p>\n<ul>\n<li>que le non-paiement du salaire invoqu\u00e9 par le salari\u00e9 n\u2019est pas une circonstance suffisamment grave pour justifier une prise d\u2019acte ;<\/li>\n<li>que le salari\u00e9 a agi de mani\u00e8re pr\u00e9matur\u00e9e.<\/li>\n<\/ul>\n<p>\u00ab Non ! \u00bb, estime le juge, qui rappelle qu\u2019au mois de juin, le salaire du mois pr\u00e9c\u00e9dent n\u2019\u00e9tait pas pay\u00e9\u2026 Un manquement imputable \u00e0 l\u2019employeur qui emp\u00eachait donc la poursuite du contrat de travail du salari\u00e9 !<\/p>\n<p>Attention, retenez que suivant les cas, la prise d\u2019acte de la rupture du contrat de travail peut \u00eatre consid\u00e9r\u00e9e par le juge comme un licenciement sans cause r\u00e9elle et s\u00e9rieuse ou comme une d\u00e9mission. Il existe toujours un risque pour le salari\u00e9 qui prend acte de la rupture du contrat de travail de ne pas obtenir gain de cause. De m\u00eame, l\u2019employeur s\u2019expose \u00e0 ce que cette prise d\u2019acte soit assimil\u00e9e \u00e0 un licenciement et donc, \u00e0 devoir verser des indemnit\u00e9s.
