Qu\u2019en dit le juge ?<\/p>\n<div>\n<h2> N\u00e9cessit\u00e9 de mettre en place un dispositif de contr\u00f4le du temps de travail<\/h2>\n<p>Un salari\u00e9 itin\u00e9rant r\u00e9clame \u00e0 son employeur le paiement d\u2019heures suppl\u00e9mentaires. Il \u00e9taye sa demande en produisant un d\u00e9compte des heures de travail qu\u2019il indique avoir accomplies durant la p\u00e9riode en cause.<\/p>\n<p>Ce d\u00e9compte mentionne, jour apr\u00e8s jour, les heures de prise et de fin de service, ainsi que de ses rendez-vous professionnels avec la mention du magasin visit\u00e9, le nombre d\u2019heures de travail quotidien et le total hebdomadaire.<\/p>\n<p>Une preuve insuffisante, selon l\u2019employeur qui rappelle que le salari\u00e9 travaille \u00e0 600 km du si\u00e8ge social de l\u2019entreprise et qu\u2019il n\u2019a jamais pr\u00e9cis\u00e9 ses horaires dans ses comptes-rendus hebdomadaires. En outre, il constate que le salari\u00e9 ne mentionne pas, sur ces d\u00e9comptes, sa pause m\u00e9ridienne.
