A tort, selon le locataire, qui rappelle qu\u2019il est victime de la crise sanitaire, et des mesures restrictives qui l\u2019accompagnent\u2026<\/p>\n<div>\n<h2> Une appr\u00e9ciation au cas par cas<\/h2>\n<p>Parce que son locataire n\u2019a pas r\u00e9gl\u00e9 son loyer entre les mois de mars \u00e0 mai 2020, le bailleur d\u2019un local commercial demande et obtient l\u2019autorisation de proc\u00e9der \u00e0 une saisie des sommes dues sur son compte bancaire.<\/p>\n<p>Une mesure contest\u00e9e par le locataire, qui en demande la suspension : il rappelle que s\u2019il n\u2019a pas r\u00e9gl\u00e9 ses loyers sur le deuxi\u00e8me trimestre 2020, c\u2019est uniquement parce que son commerce a fait l\u2019objet d\u2019une mesure de fermeture au public ordonn\u00e9e par les pouvoirs publics.<\/p>\n<p>Faute d\u2019\u00eatre responsable de la situation, il doit donc, selon lui, \u00eatre exon\u00e9r\u00e9 du paiement des loyers sur cette p\u00e9riode.<\/p>\n<p>Une position partag\u00e9e par le juge, qui rappelle que si pendant le bail, la chose lou\u00e9e (ici le local) est en tout ou partie d\u00e9truite par un \u00e9v\u00e8nement impr\u00e9visible (on parle techniquement de \u00ab cas fortuit \u00bb), le bail peut \u00eatre r\u00e9sili\u00e9, ou son prix revu \u00e0 la baisse.<\/p>\n<p>Ici, l\u2019impossibilit\u00e9 pour le locataire d\u2019exploiter les locaux lou\u00e9s r\u00e9sulte des mesures administratives ordonn\u00e9es dans le cadre de la crise sanitaire.<\/p>\n<p>Cette situation doit \u00eatre assimil\u00e9e \u00e0 la destruction du local par \u00ab cas fortuit \u00bb, et lib\u00e8re par cons\u00e9quent le locataire de l\u2019obligation de payer son loyer pour la p\u00e9riode durant laquelle il a \u00e9t\u00e9 priv\u00e9 de la jouissance des lieux lou\u00e9s.<\/p>\n<p>La demande de saisie du bailleur doit donc \u00eatre lev\u00e9e\u2026<\/p>\n<p>Pour rappel, le paiement des loyers commerciaux durant la p\u00e9riode de confinement fait l\u2019objet d\u2019un contentieux nourri.<\/p>\n<p>La position des juges n\u2019est pas homog\u00e8ne sur ce point, et d\u00e9pend dans tous les cas des faits qui leur sont soumis.<\/p>\n<p>Le jugement ici pr\u00e9sent\u00e9, qui a \u00e9t\u00e9 rendu par le tribunal judiciaire de Paris, doit donc \u00eatre appr\u00e9hend\u00e9 avec pr\u00e9caution.<\/p>\n<p>Source : Arr\u00eat du Tribunal judiciaire de Paris JEX, du 20 janvier 2021, n\u00b0 20\/80923 (NP)<\/p>\n<p><a href=\"https:\/\/www.weblex.fr\/weblex-actualite\/coronavirus-covid-19-et-locaux-commerciaux-une-avancee-en-matiere-de-dispense-de-loyer\" rel=\"nofollow noopener\" target=\"_blank\">Coronavirus (COVID\u201319) et locaux commerciaux : une avanc\u00e9e en mati\u00e8re de (dispense de) loyer ?<\/a> \u00a9 Copyright WebLex &#8211; 2021<\/p>\n<\/div>\n<\/div>\n<p><img src='https:\/\/www.weblex.fr\/images\/flux_actus\/bailcomm.jpg'><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Le bailleur d\u2019un local commercial, qui reproche \u00e0 son locataire divers impay\u00e9s de loyers, d\u00e9cide de demander une saisie sur son compte bancaire des sommes dues.
