A tort ou \u00e0 raison ?<\/p>\n<div>\n<h2>Droit de d\u00e9laissement : une d\u00e9pr\u00e9ciation qui doit \u00eatre indemnis\u00e9e !<\/h2>\n<p>Pour rappel, au nom de l\u2019int\u00e9r\u00eat g\u00e9n\u00e9ral, il peut arriver qu\u2019une commune d\u00e9cide de cr\u00e9er une \u00ab r\u00e9serve \u00bb sur un bien immobilier (terrain nu, maison, etc.) qui emp\u00eache le propri\u00e9taire de jouir pleinement de son bien.<\/p>\n<p>S\u2019il estime que la r\u00e9serve est trop contraignante, il peut utiliser son \u00ab droit de d\u00e9laissement \u00bb. Il s\u2019agit d\u2019une proc\u00e9dure administrative par laquelle il demande au b\u00e9n\u00e9ficiaire de la r\u00e9serve d\u2019acheter son bien.<\/p>\n<p>C\u2019est justement cette proc\u00e9dure qu\u2019un couple a utilis\u00e9e pour se s\u00e9parer d\u2019une parcelle de terrain situ\u00e9e au bord de la voie publique.
