Mais ces violences ne sont pas exclusivement imputables \u00e0 ce dernier, qui a lui aussi d\u00e9pos\u00e9 plainte contre la salari\u00e9e, conteste-t-il\u2026<\/p>\n<div>\n<h2> Une preuve \u00e0 la charge de l\u2019employeur !<\/h2>\n<p>Une salari\u00e9e et son sup\u00e9rieur hi\u00e9rarchique, g\u00e9rant de la soci\u00e9t\u00e9 qui l\u2019emploie, ont une violente altercation \u00e0 la suite de laquelle la salari\u00e9e d\u00e9pose plainte pour des violences physiques. Elle demande alors la r\u00e9siliation judicaire de son contrat de travail pour manquement de l\u2019employeur \u00e0 son obligation de s\u00e9curit\u00e9.<\/p>\n<p>Mais les violences ne sont pas exclusivement imputables au g\u00e9rant, qui a lui aussi d\u00e9pos\u00e9 plainte contre la salari\u00e9e \u00e0 la suite de cette altercation pour des violences physiques, remarque ce dernier. Une situation finalement ind\u00e9termin\u00e9e qui doit, selon lui, l\u2019exon\u00e9rer de toute responsabilit\u00e9.<\/p>\n<p>Mais le juge n\u2019est pas de cet avis : il rappelle que l\u2019employeur ne peut s\u2019exon\u00e9rer de sa responsabilit\u00e9 au titre de son obligation de s\u00e9curit\u00e9, que s\u2019il justifie avoir pris toutes les mesures n\u00e9cessaires, et pr\u00e9vues par la Loi, pour assurer la s\u00e9curit\u00e9 et prot\u00e9ger la sant\u00e9 physique et mentale des travailleurs.<\/p>\n<p>Pour rappel, l\u2019employeur doit :<\/p>\n<ul>\n<li>\u00e9viter les risques ;<\/li>\n<li>\u00e9valuer les risques qui ne peuvent pas \u00eatre \u00e9vit\u00e9s ;<\/li>\n<li>combattre les risques \u00e0 la source ;<\/li>\n<li>adapter le travail \u00e0 l&#8217;homme ;<\/li>\n<li>tenir compte de l&#8217;\u00e9tat d&#8217;\u00e9volution de la technique ;<\/li>\n<li>remplacer ce qui est dangereux par ce qui n&#8217;est pas dangereux ou par ce qui est moins dangereux ;<\/li>\n<li>planifier la pr\u00e9vention en y int\u00e9grant, dans un ensemble coh\u00e9rent, la technique, l&#8217;organisation du travail, les conditions de travail, les relations sociales et l&#8217;influence des facteurs ambiants, notamment les risques li\u00e9s au harc\u00e8lement moral, au harc\u00e8lement sexuel et aux agissements sexistes ;<\/li>\n<li>prendre des mesures de protection collective en leur donnant la priorit\u00e9 sur les mesures de protection individuelle ;<\/li>\n<li>donner les instructions appropri\u00e9es aux travailleurs.<\/li>\n<\/ul>\n<p>Les mesures qu\u2019il doit prendre pour ce faire comprennent :<\/p>\n<ul>\n<li>des actions de pr\u00e9vention des risques professionnels ;<\/li>\n<li>des actions d&#8217;information et de formation ;<\/li>\n<li>la mise en place d&#8217;une organisation et de moyens adapt\u00e9s.<\/li>\n<\/ul>\n<p>Faute de justifier que l\u2019employeur a pris l\u2019ensemble de ces mesures n\u00e9cessaires, sa responsabilit\u00e9 peut \u00eatre engag\u00e9e et le contrat de travail pourra \u00eatre r\u00e9sili\u00e9 \u00e0 ses torts.<\/p>\n<p>L\u2019affaire sera ici rejug\u00e9e pour permettre \u00e0 l\u2019employeur de prouver qu\u2019il a pris les mesures n\u00e9cessaires pour assurer la protection de la sant\u00e9 et de la s\u00e9curit\u00e9 de ses salari\u00e9s.<\/p>\n<p><span style=\"text-decoration: underline;\">Source :<\/span> Arr\u00eat de la Cour de Cassation, chambre sociale, du 3 f\u00e9vrier 2021, n\u00b0 19-23548<\/p>\n<p><a title=\"Titre WebLex - Manquement \u00e0 l\u2019obligation de s\u00e9curit\u00e9 : \u00ab prouvez-le ! \u00bb\" href=\"https:\/\/www.weblex.fr\/weblex-actualite\/obligation-de-securite-manquement-ou-respect-a-prouver\" rel=\"nofollow noopener\" target=\"_blank\">Manquement \u00e0 l\u2019obligation de s\u00e9curit\u00e9 : \u00ab prouvez-le ! \u00bb<\/a> \u00a9 Copyright WebLex &#8211; 2021<\/p>\n<\/div>\n<p><img src='https:\/\/www.weblex.fr\/images\/flux_actus\/obligationdesecurite.jpg'><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Une salari\u00e9e reproche \u00e0 son employeur un manquement \u00e0 son obligation de s\u00e9curit\u00e9, celle-ci ayant \u00e9t\u00e9 victime de violences physiques exerc\u00e9es par le g\u00e9rant de la soci\u00e9t\u00e9.
