{"id":537,"date":"2021-02-18T05:45:00","date_gmt":"2021-02-18T04:45:00","guid":{"rendered":"https:\/\/www.cabinet-magar.fr\/coronavirus-covid-19-et-baux-commerciaux-impayes-de-loyer-resiliation-du-bail\/"},"modified":"2021-04-06T03:00:02","modified_gmt":"2021-04-06T01:00:02","slug":"coronavirus-covid-19-et-baux-commerciaux-impayes-de-loyer-resiliation-du-bail","status":"publish","type":"post","link":"https:\/\/www.cabinet-magar.fr\/de\/actualites\/coronavirus-covid-19-et-baux-commerciaux-impayes-de-loyer-resiliation-du-bail\/","title":{"rendered":"Coronavirus (COVID-19) et baux commerciaux : impay\u00e9s de loyer = r\u00e9siliation du bail ?"},"content":{"rendered":"<p >Parce qu\u2019il constate des impay\u00e9s de loyer, le bailleur d\u2019un local commercial r\u00e9clame la r\u00e9siliation du contrat de bail \u2026 Sauf, lui rappelle son locataire, qu\u2019il ne suffit pas de r\u00e9clamer pour obtenir\u2026<\/p>\n<div>\n<h2> Coronavirus (COVID-19) et r\u00e9siliation de bail : si et seulement si\u2026<\/h2>\n<p>En d\u00e9cembre 2019, un restaurateur d\u00e9cide de louer un local commercial afin d\u2019y exercer son activit\u00e9.<\/p>\n<p>Malgr\u00e9 les nombreux travaux r\u00e9alis\u00e9s dans le local, la date d\u2019ouverture du restaurant est finalement repouss\u00e9e en raison des mesures de confinement mises en place \u00e0 compter du 12 mars 2020.<\/p>\n<p>Prenant acte de ces circonstances particuli\u00e8res, le bailleur conc\u00e8de au restaurateur une remise de 50 % sur le montant des loyers dus entre le 15 mars et le 22 juin 2020.<\/p>\n<p>A la fin du confinement, le restaurant peut enfin ouvrir ses portes, mais son fonctionnement est drastiquement adapt\u00e9 en vue de respecter les mesures de distanciation sociale et des gestes barri\u00e8res.<\/p>\n<p>Des mesures tr\u00e8s contraignantes, selon le restaurateur, qui l\u2019ont emp\u00each\u00e9 d\u2019amortir les lourds travaux d\u2019am\u00e9nagement qu\u2019il a entrepris dans le local\u2026 et qui justifient, par cons\u00e9quent, la poursuite de la mesure de r\u00e9duction de loyer entre les mois de juillet et de septembre 2020.<\/p>\n<p>Mais sa demande est cette fois rejet\u00e9e par le bailleur, qui r\u00e9clame l\u2019int\u00e9gralit\u00e9 des loyers dus sur cette p\u00e9riode. Face \u00e0 la r\u00e9sistance de son locataire, il d\u00e9cide finalement d\u2019activer la \u00ab clause r\u00e9solutoire \u00bb du contrat de bail.<\/p>\n<p>Pour m\u00e9moire, une clause r\u00e9solutoire est une clause qui permet au bailleur d\u2019obtenir la r\u00e9siliation de plein droit du bail en cas d\u2019impay\u00e9s de loyer. Il doit alors saisir le juge en urgence (on parle de proc\u00e9dure en \u00ab r\u00e9f\u00e9r\u00e9 \u00bb), qui doit constater la r\u00e9siliation de plein droit du bail.<\/p>\n<p>Mais dans cette affaire, le juge rejette la demande du bailleur : il rappelle que les contrats doivent \u00eatre ex\u00e9cut\u00e9s de bonne foi, ce qui n\u00e9cessite, en cas de circonstances exceptionnelles, que bailleur et locataire cherchent \u00e0 adapter les modalit\u00e9s d\u2019ex\u00e9cution de leurs obligations respectives.<\/p>\n<p>Ici, le bailleur a bien r\u00e9duit le montant du loyer pendant la dur\u00e9e du confinement.
