\u00bb, s\u2019interroge l\u2019int\u00e9ress\u00e9, qui ne comprend pas bien ce qu\u2019on lui reproche\u2026<\/p>\n<div>\n<h2> Vente immobili\u00e8re et loyers impay\u00e9s : responsable, mais pas coupable ?<\/h2>\n<p>Une soci\u00e9t\u00e9 civile immobili\u00e8re (SCI) vend un immeuble qu\u2019elle loue dans le cadre d\u2019un bail commercial.<\/p>\n<p>Le jour de la vente, elle s\u2019aper\u00e7oit que le locataire n\u2019a pas r\u00e9gl\u00e9 le dernier loyer d\u00fb, ce qui la pousse \u00e0 lui d\u00e9livrer un commandement de payer, et \u00e0 proc\u00e9der \u00e0 une saisie sur le compte bancaire de sa caution.<\/p>\n<p>Apr\u00e8s la vente, l\u2019acheteur de l\u2019immeuble d\u00e9cide d\u2019engager la responsabilit\u00e9 de la SCI : pour lui, en effet, la soci\u00e9t\u00e9 l\u2019a tromp\u00e9 sur les conditions d\u2019achat du bien, l\u2019acte de vente pr\u00e9cisant que le locataire a toujours pay\u00e9 son loyer\u2026 ce qui est faux, puisque depuis la conclusion du bail, celui-ci n\u2019a jamais pay\u00e9 son loyer.<\/p>\n<p>Une affirmation mensong\u00e8re qui m\u00e9rite, selon l\u2019acheteur, une indemnisation\u2026<\/p>\n<p>\u00ab Non \u00bb, r\u00e9torque la SCI, qui rappelle que les loyers dus ont toujours \u00e9t\u00e9 r\u00e9gl\u00e9s, certes pas par le locataire lui-m\u00eame, mais par sa caution, s\u00e9rieuse et solvable, qui a toujours respect\u00e9 son engagement.<\/p>\n<p>\u00ab Plus maintenant \u00bb, r\u00e9pond l\u2019acheteur, qui pr\u00e9cise que celle-ci a tout de m\u00eame fini par contester la validit\u00e9 de cet engagement.<\/p>\n<p>\u00ab Apr\u00e8s la vente seulement \u00bb, rappelle le juge, qui donne tort \u00e0 l\u2019acheteur : la mention de l\u2019acte de vente relative au paiement des loyers n\u2019est pas mensong\u00e8re puisque les loyers ont bien \u00e9t\u00e9 r\u00e9gl\u00e9s, depuis le d\u00e9but du bail, par la caution du locataire, qui n\u2019a contest\u00e9 la validit\u00e9 de son engagement que post\u00e9rieurement \u00e0 la vente.<\/p>\n<p>De plus, poursuit-il, l\u2019acqu\u00e9reur ne prouve pas que l\u2019existence du bail commercial \u00e9tait d\u00e9terminante dans le cadre de son achat.<\/p>\n<p>A d\u00e9faut d\u2019avoir \u00e9t\u00e9 tromp\u00e9, l\u2019acqu\u00e9reur n\u2019a donc pas \u00e0 \u00eatre indemnis\u00e9\u2026<\/p>\n<p>Source : Arr\u00eat de la Cour de cassation, 3\u00e8me chambre civile, du 4 mars 2021, n\u00b0 20-10657<\/p>\n<p><a href=\"https:\/\/www.weblex.fr\/weblex-actualite\/vente-dun-immeuble-loue-et-si-des-loyers-demeurent-impayes\" rel=\"nofollow noopener\" target=\"_blank\">Vente d\u2019un immeuble lou\u00e9 : et si des loyers demeurent impay\u00e9s ?<\/a> \u00a9 Copyright WebLex &#8211; 2021<\/p>\n<\/div>\n<p><img src='https:\/\/www.weblex.fr\/images\/flux_actus\/impays.jpg'><\/p>\n","protected":false},"excerpt":{"rendered":"<p>S\u2019estimant tromp\u00e9 sur les conditions de son achat, l\u2019acqu\u00e9reur d\u2019un immeuble lou\u00e9 d\u00e9cide de r\u00e9clamer une indemnisation au vendeur de celui-ci. \u00ab Quelle tromperie ?
