A tort ou \u00e0 raison ?<\/p>\n<div>\n<h2> Un transfert des moyens significatifs et n\u00e9cessaires \u00e0 la poursuite de l\u2019activit\u00e9<\/h2>\n<p>Une entreprise c\u00e8de sa marque et son activit\u00e9 de vente et conseil en t\u00e9l\u00e9phonie \u00e0 une soci\u00e9t\u00e9 repreneuse qui exploitera son activit\u00e9 dans les locaux de l\u2019entreprise c\u00e9dante.<\/p>\n<p>L\u2019entreprise c\u00e9dante c\u00e8de par la m\u00eame occasion les contrats de travail attach\u00e9s \u00e0 son activit\u00e9 \u00e0 la soci\u00e9t\u00e9 repreneuse\u2026 \u00e0 tort, selon des salari\u00e9s qui estiment que l\u2019entreprise c\u00e9dante a, ainsi, proc\u00e9d\u00e9 \u00e0 leur licenciement abusif.<\/p>\n<p>Ils constatent que l\u2019entreprise c\u00e9dante, souhaitant conserver \u00e0 son profit la vente et la distribution des stocks, a pr\u00e9vu que l\u2019entreprise repreneuse lui reversera le chiffre d\u2019affaires r\u00e9alis\u00e9 mais conservera les charges locatives et salariales.<\/p>\n<p>Ce qui d\u00e9montre l\u2019absence de transfert de moyens significatifs et n\u00e9cessaires \u00e0 la poursuite de l\u2019activit\u00e9, confirme le juge.
