Une enqu\u00eate dont elle n\u2019a pas \u00e9t\u00e9 inform\u00e9e au pr\u00e9alable, constate la salari\u00e9e\u2026 qui conteste son licenciement\u2026<\/p>\n<div>\n<h2> Enqu\u00eate interne = moyen de preuve illicite ?<\/h2>\n<p>Des faits de harc\u00e8lement moral sont d\u00e9nonc\u00e9s aupr\u00e8s d\u2019un employeur qui missionne une entreprise ext\u00e9rieure, avec l\u2019accord des repr\u00e9sentants du personnel, en vue de diligenter une enqu\u00eate.<\/p>\n<p>A l\u2019occasion de cette enqu\u00eate, il d\u00e9couvre qu\u2019une salari\u00e9e, responsable de service, tient des propos \u00e0 caract\u00e8re racial et discriminatoire, injurie des collaborateurs et cause des perturbations graves dans l\u2019organisation de l\u2019entreprise. Des faits qui motivent un licenciement pour faute grave\u2026<\/p>\n<p>\u2026 que conteste cette salari\u00e9e : selon elle, l\u2019enqu\u00eate confi\u00e9e \u00e0 l\u2019entreprise est illicite, faute pour l\u2019employeur de ne pas en avoir inform\u00e9 pr\u00e9alablement les salari\u00e9s.
