{"id":309,"date":"2021-03-25T05:48:00","date_gmt":"2021-03-25T04:48:00","guid":{"rendered":"https:\/\/www.cabinet-magar.fr\/egalite-de-remuneration-des-ecarts-a-corriger\/"},"modified":"2021-03-27T23:59:27","modified_gmt":"2021-03-27T22:59:27","slug":"egalite-de-remuneration-des-ecarts-a-corriger","status":"publish","type":"post","link":"https:\/\/www.cabinet-magar.fr\/de\/actualites\/egalite-de-remuneration-des-ecarts-a-corriger\/","title":{"rendered":"Egalit\u00e9 de r\u00e9mun\u00e9ration : des \u00e9carts \u00e0 corriger"},"content":{"rendered":"<p >Dans les entreprises d&#8217;au moins 50 salari\u00e9s, l&#8217;employeur publie chaque ann\u00e9e des indicateurs relatifs aux \u00e9carts de r\u00e9mun\u00e9ration entre les femmes et les hommes et aux actions mises en \u0153uvre pour les supprimer, selon des modalit\u00e9s et une m\u00e9thodologie qui viennent d\u2019\u00eatre pr\u00e9cis\u00e9es.<\/p>\n<div>\n<h2> Supprimer les \u00e9carts de r\u00e9mun\u00e9ration entre hommes et femmes<\/h2>\n<p>Dans les entreprises d\u2019au moins 50 salari\u00e9s, l\u2019employeur doit d\u00e9sormais, chaque ann\u00e9e, publier un \u00ab Index de l\u2019\u00e9galit\u00e9 Femmes-Hommes \u00bb, \u00e9tabli \u00e0 partir d\u2019indicateurs pr\u00e9cis et mesurant la situation de l\u2019entreprise au regard de l\u2019\u00e9galit\u00e9 salariale entre les femmes et les hommes.<\/p>\n<p>Les r\u00e9sultats doivent \u00eatre publi\u00e9s annuellement, au plus tard le 1er mars de l\u2019ann\u00e9e en cours, au titre de l\u2019ann\u00e9e pr\u00e9c\u00e9dente.<\/p>\n<p>Pour les indicateurs \u00e0 publier au plus tard le 1er mars 2022, ces r\u00e9sultats devront d\u00e9sormais \u00eatre publi\u00e9s de mani\u00e8re visible et lisible, sur le site internet de l\u2019entreprise lorsqu\u2019il en existe un. Ils doivent rester consultables sur le site internet de l\u2019entreprise au moins jusqu\u2019\u00e0 la publication, l\u2019ann\u00e9e suivante, du niveau de r\u00e9sultat et des r\u00e9sultats obtenus au titre de l\u2019ann\u00e9e en cours. \u00c0 d\u00e9faut de site internet, ils sont port\u00e9s \u00e0 la connaissance des salari\u00e9s par tout moyen.<\/p>\n<p>En fonction du niveau de cet index, l\u2019employeur devra mettre en place des mesures correctives, et, le cas \u00e9ch\u00e9ant, un plan de rattrapage salarial. \u00c0 d\u00e9faut, l\u2019entreprise pourra se voir appliquer une p\u00e9nalit\u00e9 financi\u00e8re.<\/p>\n<p>Pour les entreprises b\u00e9n\u00e9ficiant de cr\u00e9dits dans le cadre du plan de relance, lorsque les r\u00e9sultats obtenus ne sont pas suffisants, des obligations renforc\u00e9es dans le domaine de l\u2019\u00e9galit\u00e9 de r\u00e9mun\u00e9ration entre les femmes et les hommes sont pr\u00e9vues. Ainsi, d\u00e9sormais :<\/p>\n<ul>\n<li>elles devront publier le r\u00e9sultat obtenu \u00e0 chacun des indicateurs relatifs aux \u00e9carts de r\u00e9mun\u00e9ration entre les femmes et les hommes chaque ann\u00e9e au plus tard le 1er mars (cette publication sera accessible sur le site du Minist\u00e8re du Travail) ;<\/li>\n<li>elles devront fixer des objectifs de progression pour chaque indicateur pour lequel la note maximale n\u2019a pas \u00e9t\u00e9 atteinte, d\u00e8s lors que l\u2019Index de l\u2019\u00e9galit\u00e9 est inf\u00e9rieur \u00e0 75 points (ces entreprises seront \u00e9galement tenues de publier ces objectifs ainsi que les mesures de correction et de rattrapage et les porter \u00e0 la connaissance des salari\u00e9s).<\/li>\n<\/ul>\n<p>Source : D\u00e9cret n\u00b0 2021-265 du 10 mars 2021 relatif aux mesures visant \u00e0 supprimer les \u00e9carts de r\u00e9mun\u00e9ration entre les femmes et les hommes dans l&#8217;entreprise et portant application de l&#8217;article 244 de la loi n\u00b0 2020-1721 du 29 d\u00e9cembre 2020 de finances pour 2021<\/p>\n<p><a title=\"WebLex -
