Voil\u00e0 qui m\u00e9rite quelques pr\u00e9cisions\u2026<\/p>\n<h2>Rupture conventionnelle et mise \u00e0 la retraite : le taux de la contribution patronale de 40 % d\u00e9pend de la date de fin du contrat<\/h2>\n<p>La loi de financement de la s\u00e9curit\u00e9 sociale pour 2026 a relev\u00e9 de 30 % \u00e0 40 % le taux de la contribution patronale sp\u00e9cifique due sur les indemnit\u00e9s de rupture conventionnelle individuelle et sur les indemnit\u00e9s vers\u00e9es \u00e0 l\u2019occasion d\u2019une mise \u00e0 la retraite.<\/p>\n<p>Pour m\u00e9moire, cette contribution est due par l\u2019employeur sur la fraction d\u2019indemnit\u00e9 exon\u00e9r\u00e9e de cotisations sociales, que cette fraction soit ou non assujettie \u00e0 la CSG et \u00e0 la CRDS.<\/p>\n<p>Sur le principe de la hausse du taux, le texte ne soulevait pas de difficult\u00e9 particuli\u00e8re. En revanche, une incertitude demeurait sur son entr\u00e9e en vigueur concr\u00e8te puisque rien n\u2019\u00e9tait dit sur la date d\u2019entr\u00e9e en vigueur de cette hausse de la contribution.<\/p>\n<p>D\u00e8s lors, on pouvait certes consid\u00e9rer que la mesure, figurant dans la partie de la loi relative aux recettes de l\u2019exercice 2026, s\u2019applique \u00e0 compter du 1er janvier 2026.
