Des pr\u00e9cisions sont apport\u00e9es pour la mise en place effective de ces changements\u2026<\/p>\n<h2>Diverses mesures pour moderniser et simplifier plusieurs d\u00e9marches en copropri\u00e9t\u00e9<\/h2>\n<p>La loi relative \u00e0 l\u2019acc\u00e9l\u00e9ration et \u00e0 la simplification de la r\u00e9novation de l\u2019habitat d\u00e9grad\u00e9, adopt\u00e9e en 2024, pr\u00e9voit de nombreuses mesures tendant \u00e0 la pr\u00e9vention de la d\u00e9gradation des habitations et \u00e0 l\u2019acc\u00e9l\u00e9ration de la r\u00e9habilitation de l\u2019habitat d\u00e9j\u00e0 d\u00e9grad\u00e9.<\/p>\n<p>Plusieurs des mesures de cette loi mettent en place des dispositifs d\u00e9di\u00e9s \u00e0 l\u2019am\u00e9lioration de la situation dans les copropri\u00e9t\u00e9s, selon des modalit\u00e9s qui viennent d\u2019\u00eatre pr\u00e9cis\u00e9es, permettant ainsi l\u2019application effective de certaines de ces mesures.<\/p>\n<h3>Copropri\u00e9t\u00e9 et emprunt collectif<\/h3>\n<p>La loi a instaur\u00e9 la possibilit\u00e9, lors des assembl\u00e9es g\u00e9n\u00e9rales (AG) de copropri\u00e9t\u00e9, de voter la sollicitation d\u2019un pr\u00eat collectif.<\/p>\n<p>Ce pr\u00eat doit avoir pour objectif de financer des travaux portant sur les parties communes ou des parties privatives s\u2019il en va de l\u2019int\u00e9r\u00eat commun de la copropri\u00e9t\u00e9.<\/p>\n<p>Dans l\u2019hypoth\u00e8se de la souscription d\u2019un tel emprunt suivie de la vente d\u2019un lot, il est pr\u00e9cis\u00e9 que le syndic r\u00e9digeant un \u00e9tat dat\u00e9 devra y renseigner les mentions suivantes relatives \u00e0 cet emprunt :<\/p>\n<ul>\n<li>le montant restant d\u00fb par le propri\u00e9taire vendeur ;<\/li>\n<li>le montant vers\u00e9 par l&#8217;\u00e9tablissement de cautionnement en cas de d\u00e9faillance du copropri\u00e9taire vendeur dans le paiement du remboursement de l&#8217;emprunt ou dans le paiement de sa contribution au remboursement de l&#8217;emprunt.<\/li>\n<\/ul>\n<p>Il est par ailleurs pr\u00e9vu que le syndic doit adresser \u00e0 chaque copropri\u00e9taire un avis indiquant le montant des sommes dues pour le versement des contributions au remboursement de l&#8217;emprunt collectif. Cet avis est transmis avant la date d\u2019exigibilit\u00e9 pr\u00e9vue par l\u2019AG.<\/p>\n<p>Il est \u00e9galement pr\u00e9cis\u00e9 que la gestion et le suivi de l\u2019emprunt collectif entrent dans les postes que le syndic peut facturer au syndicat des copropri\u00e9taires.<\/p>\n<h3>Copropri\u00e9t\u00e9 et travaux r\u00e9alis\u00e9s dans les parties communes par un copropri\u00e9taire<\/h3>\n<p>La loi pr\u00e9voyait la possibilit\u00e9 pour un copropri\u00e9taire de demander lors d\u2019une AG l\u2019autorisation de faire effectuer \u00e0 ses frais des travaux d\u2019isolation touchant des plafonds ou des planchers relevant des parties communes de l\u2019immeuble.<\/p>\n<p>Il est pr\u00e9cis\u00e9 que le syndic saisi d\u2019une telle demande devra l\u2019inscrire \u00e0 l\u2019ordre du jour de l\u2019AG qui suit imm\u00e9diatement la demande.<\/p>\n<p>Si le copropri\u00e9taire obtient l\u2019autorisation attendue, il pourra entamer les travaux apr\u00e8s l\u2019expiration d\u2019un d\u00e9lai de 2 mois suivant la notification du proc\u00e8s-verbal de l\u2019AG afin de purger le d\u00e9lai de contestation.<\/p>\n<p>Le syndic veille \u00e0 ce que les travaux soient r\u00e9alis\u00e9s conform\u00e9ment au descriptif qui accompagne la demande du copropri\u00e9taire.<\/p>\n<h3>Copropri\u00e9t\u00e9 et d\u00e9mat\u00e9rialisation des d\u00e9marches<\/h3>\n<p>Il est d\u00e9sormais pr\u00e9vu que les notifications de mises en demeure peuvent se faire de fa\u00e7on d\u00e9mat\u00e9rialis\u00e9e :<\/p>\n<ul>\n<li>soit au moyen de lettres recommand\u00e9es \u00e9lectroniques ;<\/li>\n<li>soit au moyen d&#8217;un proc\u00e9d\u00e9 \u00e9lectronique mis en \u0153uvre par l&#8217;interm\u00e9diaire d&#8217;un prestataire de services de confiance qualifi\u00e9 et garantissant l&#8217;int\u00e9grit\u00e9 des donn\u00e9es, la s\u00e9curit\u00e9, ainsi que la tra\u00e7abilit\u00e9 des communications.<\/li>\n<\/ul>\n<p>Pour ces modes de notification, il est consid\u00e9r\u00e9 que les d\u00e9lais qu\u2019ils font courir d\u00e9marrent \u00e0 compter du lendemain de leur d\u00e9livrance.<\/p>\n<p>La d\u00e9mat\u00e9rialisation devenant le principe, la notification par lettre recommand\u00e9e avec demande d\u2019avis de r\u00e9ception est toujours possible par exception.<\/p>\n<p>Ici, les d\u00e9lais commencent \u00e0 courir au lendemain du jour de la premi\u00e8re pr\u00e9sentation de la lettre.<\/p>\n<p>\u00c0 cet effet, le syndic doit accompagner ses avis d\u2019appels de charges et ses convocations aux AG d\u2019une mention informant les copropri\u00e9taires sur la possibilit\u00e9 de faire le choix d\u2019une notification par voie postale.<\/p>\n<p>Les copropri\u00e9taires souhaitant privil\u00e9gier ce mode de communication devront en informer le syndic.<\/p>\n<div>Sources :  <\/p>\n<ul>\n<li><a href=\"https:\/\/www.legifrance.gouv.fr\/jorf\/id\/JORFTEXT000053159903\" target=\"_blank\">D\u00e9cret no 2025-1292 du 22 d\u00e9cembre 2025 modifiant le d\u00e9cret no 67-223 du 17 mars 1967 pris pour l&#8217;application de la loi no 65-557 du 10 juillet 1965 fixant le statut de la copropri\u00e9t\u00e9 des immeubles b\u00e2tis<\/a><\/li>\n<\/ul>\n<\/div>\n<p><a href=\"https:\/\/www.weblex.fr\/weblex-actualite\/coproprietes-des-mesures-de-simplification-effectives\" target=\"_blank\">Copropri\u00e9t\u00e9s : des mesures de simplification effectives<\/a> &#8211; \u00a9 Copyright WebLex<\/p>\n<p><img decoding=\"async\" src=\"https:\/\/www.weblex.fr\/sites\/default\/files\/actualites\/images\/Shutterstock_coproprietes.jpg\"><\/p>\n","protected":false},"excerpt":{"rendered":"<p>En 2024, la loi relative \u00e0 l\u2019acc\u00e9l\u00e9ration et \u00e0 la simplification de la r\u00e9novation de l\u2019habitat d\u00e9grad\u00e9 pr\u00e9voyait un certain nombre de mesures applicables aux immeubles soumis au statut de la copropri\u00e9t\u00e9.
