Objectif de ce texte : lever les contraintes r\u00e9glementaires pour faciliter la production de logements.<\/p>\n<h2>Nouveaux logements : d\u00e9roger pour simplifie<\/h2>\n<p>Pour apporter des solutions \u00e0 la probl\u00e9matique du logement, la loi Huwart comporte une s\u00e9rie de mesures d\u00e9rogeant \u00e0 la r\u00e9glementation en vigueur.<\/p>\n<h3>S\u2019agissant de la r\u00e9fection et sur\u00e9l\u00e9vation des constructions<\/h3>\n<p>Les hypoth\u00e8ses de refus d\u2019autorisation d\u2019urbanisme pour des travaux de sur\u00e9l\u00e9vation ou de transformation limit\u00e9e de b\u00e2timents d\u00e9j\u00e0 existants sont r\u00e9duites.<\/p>\n<p>En effet, un tel projet ne pourra plus \u00eatre refus\u00e9 sur le seul fondement de la non-conformit\u00e9 de la construction initiale aux r\u00e8gles applicables en mati\u00e8re d&#8217;implantation, d&#8217;emprise au sol et d&#8217;aspect ext\u00e9rieur des constructions.<\/p>\n<p>Attention, cet assouplissement n\u2019est applicable que si la construction initiale avait \u00e9t\u00e9 r\u00e9guli\u00e8rement \u00e9difi\u00e9e.<\/p>\n<h3>S\u2019agissant du permis multisites<\/h3>\n<p>La loi \u00e9largit l\u2019utilisation du permis d\u2019am\u00e9nager multisites \u00e0 l\u2019ensemble des lotissements. Jusqu\u2019\u00e0 pr\u00e9sent, il \u00e9tait notamment r\u00e9serv\u00e9 \u00e0 des projets partenariaux d\u2019am\u00e9nagement (PPA) et \u00e0 des op\u00e9rations de revitalisation de territoire (ORT).<\/p>\n<p>Il permet de faciliter l\u2019instruction des autorisations d\u2019urbanisme d\u2019op\u00e9rations complexes touchant des parcelles non contig\u00fces. Attention, 3 conditions doivent \u00eatre r\u00e9unies :<\/p>\n<ul>\n<li>la demande est d\u00e9pos\u00e9e par un demandeur unique ;<\/li>\n<li>le projet constitue un ensemble unique et coh\u00e9rent ;<\/li>\n<li>le projet garantit l&#8217;unit\u00e9 architecturale et paysag\u00e8re des sites concern\u00e9s.<\/li>\n<\/ul>\n<p>Le projet peut \u00e9galement int\u00e9grer une ou plusieurs parcelles \u00e0 renaturer dans le cadre d\u2019un permis d\u2019am\u00e9nager multisites.<\/p>\n<h3>En mati\u00e8re de d\u00e9rogations aux documents d\u2019urbanisme<\/h3>\n<p>Par principe, le changement de destination des constructions ou des installations n\u00e9cessaires aux activit\u00e9s agricoles ou foresti\u00e8res ou aux cultures marines est interdit.<\/p>\n<p>Cette r\u00e8gle supporte \u00e0 pr\u00e9sent une exception pour les b\u00e2timents agricoles et forestiers puisque leur destination peut, sous conditions, \u00eatre modifi\u00e9e, sous r\u00e9serve que le projet ne soit pas de nature \u00e0 porter atteinte \u00e0 l&#8217;environnement ou aux paysages.<\/p>\n<p>De m\u00eame, les changements de destinations sont par ailleurs \u00e9galement facilit\u00e9s dans les zones naturelles, agricoles et foresti\u00e8res (NAF ).<\/p>\n<p>Plus largement, il est possible pour les autorit\u00e9s comp\u00e9tentes de d\u00e9roger \u00e0 certaines interdictions pr\u00e9vues par le plan local d\u2019urbanisme (PLU).<\/p>\n<p>Ainsi, la construction de logements et d\u2019\u00e9quipements publics dans les zones d&#8217;activit\u00e9s \u00e9conomiques (ZAE) peut, toutes conditions remplies, \u00eatre autoris\u00e9e, malgr\u00e9 l\u2019existence d\u2019une interdiction initiale.<\/p>\n<p>Il en va de m\u00eame pour la construction de logements \u00e9tudiants qui peut \u00eatre autoris\u00e9e dans les zones urbaines ou \u00e0 urbaniser.<\/p>\n<h3>S\u2019agissant des r\u00e9sidences h\u00f4teli\u00e8res \u00e0 vocation sociale (RHVS)<\/h3>\n<p>Il est possible pour les autorit\u00e9s comp\u00e9tentes de louer des RHVS, normalement destin\u00e9es aux personnes en situation de pr\u00e9carit\u00e9, \u00e0 des travailleurs dans les territoires pr\u00e9sentant des besoins particuliers en mati\u00e8re de logement li\u00e9s \u00e0 des enjeux de d\u00e9veloppement de nouvelles activit\u00e9s \u00e9conomiques, d\u2019industrialisation, d\u2019accueil de travailleurs saisonniers ou en mobilit\u00e9 professionnelle.<\/p>\n<p>Sont vis\u00e9s en particulier par cet assouplissement, qui durera 10 ans, les chantiers nucl\u00e9aires et les projets de r\u00e9industrialisation d\u2019un territoire.<\/p>\n<h3>S\u2019agissant de la cr\u00e9ation de r\u00e9sidences \u00e0 vocation d\u2019emploi<\/h3>\n<p>La loi cr\u00e9e un cadre sp\u00e9cifique pour \u00ab les r\u00e9sidences \u00e0 vocation d&#8217;emploi \u00bb.<\/p>\n<p>Il s\u2019agit d\u2019un ensemble d&#8217;habitations constitu\u00e9 de logements meubl\u00e9s, lou\u00e9s pour une dur\u00e9e d&#8217;une semaine \u00e0 18 mois. Ces logements sont r\u00e9serv\u00e9s aux \u00e9tudiants, apprentis, stagiaires ou volontaires du service civique. Peuvent \u00e9galement y pr\u00e9tendre les personnes en cours de mutation professionnelle ou en mission temporaire dans le cadre de leur activit\u00e9 professionnelle.<\/p>\n<p>Notez qu\u2019au moins 80 % des logements d\u2019une telle r\u00e9sidence doivent \u00eatre lou\u00e9s en respectant des r\u00e8gles de ressources des locataires et de plafonds de loyers.<\/p>\n<h3>En mati\u00e8re de recours et de contentieux<\/h3>\n<p>Afin de s\u00e9curiser les projets, la proc\u00e9dure a \u00e9galement \u00e9t\u00e9 adapt\u00e9e et acc\u00e9l\u00e9r\u00e9e.<\/p>\n<p>Ainsi, le d\u00e9lai pour former un recours gracieux a \u00e9t\u00e9 r\u00e9duit de moiti\u00e9, passant de 2 mois \u00e0 1 mois.<\/p>\n<p>De plus, ce recours ne proroge plus le d\u00e9lai de recours contentieux.
