R\u00e9ponse du juge\u2026<\/p>\n<h2>Enregistrement clandestin de l\u2019employeur : recevabilit\u00e9 admise, mais limit\u00e9e\u2026<\/h2>\n<p>En mati\u00e8re sociale, une preuve obtenue de fa\u00e7on illicite ou d\u00e9loyale, par exemple \u00e0 l\u2019insu de la personne qu\u2019elle met en cause, peut parfois \u00eatre admise en justice.<\/p>\n<p>Mais attention : c\u2019est uniquement lorsqu\u2019elle est absolument indispensable pour exercer le droit invoqu\u00e9, et \u00e0 condition que l\u2019atteinte port\u00e9e au droit des personnes soit proportionn\u00e9e au but recherch\u00e9.<\/p>\n<p>Dans cette affaire, un salari\u00e9 voit son CDD rompu de mani\u00e8re anticip\u00e9e. Selon lui, cette rupture est li\u00e9e \u00e0 son statut de travailleur handicap\u00e9.<\/p>\n<p>Pour \u00e9tayer sa position, il produit plusieurs \u00e9l\u00e9ments, dont la retranscription d\u2019un enregistrement audio de son employeur, r\u00e9alis\u00e9 \u00e0 son insu, et qui prouverait que la rupture anticip\u00e9e du CDD doit \u00eatre annul\u00e9e car elle repose sur un motif discriminatoire.<\/p>\n<p>\u00ab Preuve irrecevable \u00bb selon l\u2019employeur : cet enregistrement audio est une preuve d\u00e9loyale puisqu\u2019il a \u00e9t\u00e9 obtenu \u00e0 son insu, clandestinement.<\/p>\n<p>Or, rappelle l\u2019employeur, une preuve d\u00e9loyale n\u2019est admise que lorsqu\u2019elle constitue le seul moyen pour le salari\u00e9 de fonder ses arguments.<\/p>\n<p>Et ici, le salari\u00e9 a produit cet enregistrement en plus d\u2019autres pi\u00e8ces. Cet enregistrement audio n\u2019est donc pas absolument indispensable au soutien de ses demandes et doit \u00eatre \u00e9cart\u00e9 des d\u00e9bats.<\/p>\n<p>\u00ab Tout \u00e0 fait ! \u00bb tranche le juge : l\u2019enregistrement clandestin de l\u2019employeur ne peut pas constituer une preuve recevable en justice d\u00e8s lors qu\u2019il n\u2019est pas le seul \u00e9l\u00e9ment de preuve permettant de fonder les faits invoqu\u00e9s par le salari\u00e9.<\/p>\n<p>Ainsi, la d\u00e9cision nous rappelle que si les preuves d\u00e9loyales sont admises en justice, ce n\u2019est que dans l\u2019hypoth\u00e8se o\u00f9 leur production est absolument indispensable pour soutenir les demandes faites en justice.
