La question se pose lorsqu\u2019un salari\u00e9 arr\u00eat\u00e9, pourtant tenu \u00e0 une obligation de loyaut\u00e9, sonde, m\u00eame en vain, la client\u00e8le de son employeur pour proposer ses services\u2026<\/p>\n<h2>Tentative avort\u00e9e d\u2019exercice d\u2019une activit\u00e9 concurrente pendant l\u2019arr\u00eat = faute ?<\/h2>\n<p>En principe, le fait pour un salari\u00e9 d\u2019exercer une activit\u00e9 pendant une p\u00e9riode de suspension de son contrat de travail (par exemple lors d\u2019un arr\u00eat maladie) ne constitue pas une faute pouvant justifier un licenciement, sauf si une clause statutaire ou une stipulation pr\u00e9voit explicitement le contraire.<\/p>\n<p>Cependant, la situation est diff\u00e9rente si cette activit\u00e9 porte pr\u00e9judice \u00e0 l\u2019employeur. C\u2019est le cas, par exemple, lorsque le salari\u00e9 exerce une activit\u00e9 concurrente \u00e0 celle de l\u2019entreprise qui l\u2019emploie, toujours pendant une p\u00e9riode de suspension du contrat de travail.<\/p>\n<p>Dans une telle hypoth\u00e8se, le salari\u00e9 manque \u00e0 son obligation de loyaut\u00e9, laquelle impose de ne pas nuire aux int\u00e9r\u00eats de l\u2019employeur.<\/p>\n<p>Cette obligation de loyaut\u00e9 demeure m\u00eame pendant les p\u00e9riodes o\u00f9 le contrat de travail est suspendu, comme le juge a eu l\u2019occasion de le rappeler\u2026<\/p>\n<p>Dans cette affaire, un peintre est licenci\u00e9 pour faute grave par son employeur qui lui reproche d\u2019avoir manqu\u00e9 \u00e0 son obligation de loyaut\u00e9.<\/p>\n<p>La raison ?
