Voil\u00e0 qui m\u00e9rite quelques explications\u2026<\/p>\n<h2>CDI de valorisation de l\u2019exp\u00e9rience : un nouveau contrat exp\u00e9rimental\u2026<\/h2>\n<p>Dans le but de valoriser l\u2019exp\u00e9rience des travailleurs les plus \u00e2g\u00e9s, la loi pr\u00e9voit d\u00e9sormais la possibilit\u00e9 de recourir, \u00e0 titre exp\u00e9rimental, \u00e0 un nouveau contrat de travail \u00e0 dur\u00e9e ind\u00e9termin\u00e9e intitul\u00e9 \u00ab contrat de valorisation de l\u2019exp\u00e9rience \u00bb (ou \u00ab CVE \u00bb).<\/p>\n<p>L\u2019employeur pourra y recourir, pour une dur\u00e9e de 5 ans \u00e0 compter du 24 octobre 2025 et sous r\u00e9serve que le salari\u00e9 remplisse toutes les conditions suivantes :<\/p>\n<ul>\n<li>avoir au moins 60 ans (ou l\u2019\u00e2ge fix\u00e9 par une convention ou un accord de branche \u00e9tendu dans une fourchette allant de 57 \u00e0 60 ans) ;<\/li>\n<li>\u00eatre inscrit sur la liste des demandeurs d\u2019emploi aupr\u00e8s de l\u2019op\u00e9rateur France Travail ;<\/li>\n<li>ne pas encore b\u00e9n\u00e9ficier d\u2019une pension de retraite \u00e0 taux plein de droit propre (sauf exceptions tenant \u00e0 certains r\u00e9gimes sp\u00e9ciaux de retraite existant encore) ;<\/li>\n<li>ne pas avoir \u00e9t\u00e9 embauch\u00e9 dans l\u2019entreprise, ou dans une entreprise appartenant au m\u00eame groupe, au cours des 6 mois pr\u00e9c\u00e9dant l\u2019embauche dans l\u2019entreprise.<\/li>\n<\/ul>\n<p>Compte tenu de ces conditions, le salari\u00e9 devra remettre \u00e0 son employeur un document transmis par l\u2019Assurance retraite faisant \u00e9tat de la date pr\u00e9visionnelle \u00e0 laquelle il remplira les conditions pour b\u00e9n\u00e9ficier d\u2019une retraite \u00e0 taux plein.<\/p>\n<p>Au besoin, ce document pourra faire l\u2019objet d\u2019une mise \u00e0 jour par le salari\u00e9, garantissant le fait que l\u2019employeur dispose d\u2019une version actualis\u00e9e.<\/p>\n<h3>\u2026 assorti d\u2019un r\u00e9gime de mise \u00e0 la retraite progressive d\u00e9rogatoire d\u00e9di\u00e9&nbsp;<\/h3>\n<p>En contrepartie et toutes ces conditions pr\u00e9alables remplies, l\u2019employeur pourra mettre le salari\u00e9 \u00e0 la retraite plus facilement.&nbsp;<\/p>\n<p>Ainsi, par d\u00e9rogation \u00e0 la proc\u00e9dure de mise \u00e0 la retraite, le salari\u00e9 titulaire d\u2019un CVE pourra \u00eatre mis \u00e0 la retraite par son employeur, sans recueil de son consentement pr\u00e9alable, \u00e0 partir du moment o\u00f9 le salari\u00e9 :<\/p>\n<ul>\n<li>a atteint l\u2019\u00e2ge l\u00e9gal de d\u00e9part \u00e0 la retraite (entre 62 et 64 ans en fonction de son ann\u00e9e de naissance) ;<\/li>\n<li>ou, a atteint l\u2019\u00e2ge l\u00e9gal d\u2019attribution du taux plein automatique (soit 67 ans).<\/li>\n<\/ul>\n<p>Dans ce cas de figure, l\u2019employeur sera tout de m\u00eame tenu de respecter un d\u00e9lai de pr\u00e9avis identique \u00e0 celui en cas de licenciement et de verser au salari\u00e9 une indemnit\u00e9 de mise \u00e0 la retraite qui ne peut pas \u00eatre inf\u00e9rieure \u00e0 l\u2019indemnit\u00e9 de licenciement.<\/p>\n<p>L\u2019employeur, qui met un salari\u00e9 \u00e0 la retraite selon cette proc\u00e9dure d\u00e9rogatoire pr\u00e9vue pour le contrat de valorisation de l\u2019exp\u00e9rience, pourra \u00eatre exon\u00e9r\u00e9 de la contribution patronale de 30 %, normalement due sur l\u2019indemnit\u00e9 de mise \u00e0 la retraite vers\u00e9e au salari\u00e9.<\/p>\n<p>Pour l\u2019heure, cette exon\u00e9ration de la contribution patronale sp\u00e9cifique ne sera possible qu\u2019au cours des 3 premi\u00e8res ann\u00e9es de cette exp\u00e9rimentation.<\/p>\n<p>Notez que parall\u00e8lement \u00e0 cette nouvelle proc\u00e9dure de mise \u00e0 la retraite du salari\u00e9 embauch\u00e9 en CVE, la proc\u00e9dure de mise \u00e0 la retraite progressive \u00ab classique \u00bb a elle aussi \u00e9t\u00e9 am\u00e9nag\u00e9e par la r\u00e9forme.<\/p>\n<div>Sources :  <\/p>\n<ul>\n<li><a href=\"https:\/\/www.legifrance.gouv.fr\/jorf\/id\/JORFTEXT000052430940\" target=\"_blank\">Loi no 2025-989 du 24 octobre 2025 portant transposition des accords nationaux interprofessionnels en faveur de l&#8217;emploi des salari\u00e9s exp\u00e9riment\u00e9s et relatif \u00e0 l&#8217;\u00e9volution du dialogue social (1)<\/a><\/li>\n<\/ul>\n<\/div>\n<p><a href=\"https:\/\/www.weblex.fr\/weblex-actualite\/loi-travail-des-seniors-un-nouveau-cdi-de-valorisation-de-l-experience\" target=\"_blank\">Loi travail des seniors : un nouveau CDI de valorisation de l\u2019exp\u00e9rience <\/a> &#8211;
