Mais alors, qu\u2019en est-il des crit\u00e8res comportementaux du salari\u00e9 ? R\u00e9ponse du juge\u2026<\/p>\n<h2>\u00c9valuation de \u00ab l\u2019honn\u00eatet\u00e9 \u00bb et du \u00ab bon sens \u00bb des salari\u00e9s : licite ?<\/h2>\n<p>Dans le cadre du contrat de travail, l\u2019employeur a la possibilit\u00e9 de donner des directives, d\u2019en contr\u00f4ler l\u2019application et de sanctionner les \u00e9ventuels manquements du salari\u00e9.<\/p>\n<p>Ce pouvoir de contr\u00f4le se traduit par la possibilit\u00e9 pour l\u2019employeur d\u2019\u00e9valuer, tout au long de la relation de travail, l\u2019aptitude professionnelle du salari\u00e9.<\/p>\n<p>Mais ce pouvoir d\u2019\u00e9valuation n\u2019est pas absolu : il doit reposer sur des crit\u00e8res pr\u00e9cis, objectifs et pertinents au regard de la finalit\u00e9 professionnelle.<\/p>\n<p>Dans ce cadre, une entreprise a recours \u00e0 un \u00ab entretien de d\u00e9veloppement individuel \u00bb destin\u00e9 \u00e0 \u00e9valuer les comp\u00e9tences techniques et comportementales des salari\u00e9s.<\/p>\n<p>Dans la partie consacr\u00e9e aux comportements professionnels figurent notamment les crit\u00e8res d&#8217;\u00ab optimisme \u00bb, d&#8217;\u00ab honn\u00eatet\u00e9 \u00bb et de \u00ab bon sens \u00bb des salari\u00e9s.<\/p>\n<p>Estimant ces crit\u00e8res trop subjectifs et moralisateurs, plusieurs salari\u00e9s saisissent le juge. Pour eux, ces notions portent atteinte \u00e0 la vie personnelle des salari\u00e9s et ne pr\u00e9sentent aucun lien direct avec leurs aptitudes professionnelles.<\/p>\n<p>Ce dont se d\u00e9fend l\u2019employeur, qui rappelle que la capacit\u00e9 professionnelle d\u2019un salari\u00e9 ne s\u2019arr\u00eate pas \u00e0 ses seules aptitudes professionnelles et techniques, mais aussi \u00e0 ses facult\u00e9s d\u2019adaptation et \u00e0 ses comp\u00e9tences d\u2019int\u00e9gration \u00e0 une \u00e9quipe.<\/p>\n<p>Par ailleurs, les notions critiqu\u00e9es par les salari\u00e9s ne se trouvent que dans la partie relative \u00e0 l\u2019\u00e9valuation comportementale des salari\u00e9s, laquelle n\u2019est pas la partie principale relative \u00e0 l\u2019\u00e9valuation du travail et des objectifs.<\/p>\n<p>Ce qui ne suffit pas \u00e0 convaincre le juge, qui donne raison aux salari\u00e9s : la m\u00e9thode d\u2019\u00e9valuation des salari\u00e9s doit reposer sur des crit\u00e8res pr\u00e9cis, objectifs et pertinents au regard des comp\u00e9tences professionnelles du salari\u00e9.<\/p>\n<p>Si l\u2019utilisation de crit\u00e8res comportementaux dans la m\u00e9thode d\u2019\u00e9valuation n\u2019est pas interdite, elle n\u2019est admise qu\u2019\u00e0 la condition d\u2019\u00eatre justifi\u00e9e par la nature de l\u2019emploi occup\u00e9 et doit rester strictement li\u00e9e \u00e0 l\u2019activit\u00e9 professionnelle.
