L\u2019employeur doit alors pr\u00e9ciser la nature et le motif de la sanction envisag\u00e9e. Mais une question cruciale s\u2019est pos\u00e9e r\u00e9cemment : doit-il aussi informer le salari\u00e9 de son droit \u00e0 garder le silence ?<\/p>\n<h2>Entretien pr\u00e9alable : le \u00ab droit de se taire \u00bb r\u00e9duit au silence ?<\/h2>\n<p>Lorsqu\u2019un salari\u00e9 est convoqu\u00e9 \u00e0 un entretien pr\u00e9alable dans le cadre d\u2019une proc\u00e9dure disciplinaire, l\u2019employeur doit indiquer la sanction envisag\u00e9e et la raison sur laquelle elle se fonde\u2026<\/p>\n<p>En revanche et jusqu\u2019\u00e0 pr\u00e9sent, rien n\u2019imposait \u00e0 l\u2019employeur d\u2019informer le salari\u00e9 de son droit de garder le silence pendant cet entretien.<\/p>\n<p>Pour certains salari\u00e9s, cette absence d\u2019information est contraire \u00e0 la Constitution et plus pr\u00e9cis\u00e9ment au principe fondamental selon lequel \u00ab nul n\u2019est tenu de s\u2019accuser \u00bb, d&#8217;o\u00f9 d\u00e9coule le droit de se taire.<\/p>\n<p>D\u00e8s lors, le fait de ne pas informer le salari\u00e9 de son droit de se taire pendant l\u2019entretien pr\u00e9alable violerait la Constitution.<\/p>\n<p>Selon eux, une cons\u00e9cration d\u2019un v\u00e9ritable \u00ab droit de se taire \u00bb est n\u00e9cessaire, lequel se traduirait en droit du travail par une information pr\u00e9alable de l\u2019employeur \u00e0 cet \u00e9gard.<\/p>\n<p>Une position qui n\u2019est pas partag\u00e9e par le Conseil constitutionnel : en l\u2019\u00e9tat, la r\u00e9glementation est bel et bien conforme \u00e0 la Constitution.<\/p>\n<p>Dans sa d\u00e9cision, le Conseil rappelle que le droit de se taire, au sens constitutionnel du terme, ne s\u2019applique qu\u2019aux peines et sanctions ayant le caract\u00e8re d\u2019une punition. Ce qui n\u2019est pas le cas des sanctions prises dans le cadre du droit du travail\u2026<\/p>\n<p>En effet, le \u00ab droit de se taire \u00bb consacr\u00e9 ici ne s\u2019applique qu\u2019aux punitions et sanctions traduisant l\u2019exercice du pouvoir \u00e9tatique (et de pr\u00e9rogatives de puissance publique).<\/p>\n<p>Or, ici, les sanctions prises dans le cadre du droit du travail (et donc d\u2019un contrat de travail priv\u00e9) ne traduisent pas l\u2019exercice d\u2019une sanction au sens de l\u2019autorit\u00e9 publique.
