C\u2019est \u00e0 cette question que le juge vient d\u2019apporter une r\u00e9ponse \u2026<\/p>\n<h2>Discrimination syndicale : nul besoin de prouver un dommage pour obtenir r\u00e9paration<\/h2>\n<p>Par principe, toute personne qui s\u2019estime victime d\u2019un pr\u00e9judice doit pouvoir \u00eatre en mesure de le prouver si elle entend pr\u00e9tendre \u00e0 une indemnisation : les r\u00e8gles de responsabilit\u00e9 civile imposent, en effet, qu\u2019un pr\u00e9judice puisse \u00eatre indemnis\u00e9 \u00e0 la condition qu\u2019il soit certain, direct, l\u00e9gitime et personnel.<\/p>\n<p>Mais il peut arriver qu\u2019un pr\u00e9judice soit reconnu sans qu\u2019il soit n\u00e9cessaire de prouver la r\u00e9alit\u00e9 de ce pr\u00e9judice : on parle alors de pr\u00e9judice \u00ab automatique \u00bb.<\/p>\n<p>Ici, un salari\u00e9, par ailleurs repr\u00e9sentant du personnel, est licenci\u00e9 par son employeur, pour inaptitude et impossibilit\u00e9 de reclassement.<\/p>\n<p>Mais, consid\u00e9rant que cette inaptitude est cons\u00e9cutive \u00e0 un harc\u00e8lement de la part de son employeur d\u00fb \u00e0 sa qualit\u00e9 de repr\u00e9sentant du personnel, ce salari\u00e9 saisit le juge d\u2019une demande de dommages-int\u00e9r\u00eats.<\/p>\n<p>Selon lui, il a \u00e9t\u00e9 victime de discrimination syndicale et son employeur est donc tenu de le d\u00e9dommager pour le pr\u00e9judice qui en r\u00e9sulte.<\/p>\n<p>\u00ab Lequel ? \u00bb, conteste l\u2019employeur, en rappelant qu\u2019ici le salari\u00e9 ne fait \u00e9tat d\u2019aucun dommage r\u00e9sultant de cette discrimination syndicale.<\/p>\n<p>Or, rappelle-t-il, sans dommage, pas de r\u00e9paration ! Le salari\u00e9 doit prouver l\u2019existence d\u2019un pr\u00e9judice d\u00e9coulant de la discrimination syndicale pour pouvoir \u00eatre indemnis\u00e9.<\/p>\n<p>\u00ab Pas n\u00e9cessairement \u00bb, tranche finalement le juge en faveur du salari\u00e9 : le seul constat de l\u2019existence d\u2019une discrimination syndicale doit ouvrir droit \u00e0 r\u00e9paration.
