Illustration dans cette d\u00e9cision r\u00e9cente\u2026<\/p>\n<h2>APC : attention \u00e0 l\u2019existence des n\u00e9cessit\u00e9s du fonctionnement de l\u2019entreprise !<\/h2>\n<p>Par exception au r\u00e9gime de la modification du contrat de travail, un employeur peut imposer des modifications de contrat au salari\u00e9 via la n\u00e9gociation et l\u2019adoption d\u2019un accord de performance collective (APC).<\/p>\n<p>Pour m\u00e9moire, cet APC est un type particulier d\u2019accord collectif qui pr\u00e9voit des am\u00e9nagements en mati\u00e8re d\u2019organisation de travail, de sa dur\u00e9e ou de la r\u00e9mun\u00e9ration des salari\u00e9s pour r\u00e9pondre \u00e0 des n\u00e9cessit\u00e9s li\u00e9es au fonctionnement de l\u2019entreprise pour pr\u00e9server ou d\u00e9velopper l\u2019emploi.<\/p>\n<p>Si ces conditions sont r\u00e9unies et que le salari\u00e9 refuse la modification contenue dans l\u2019APC, l\u2019employeur pourra le licencier en raison de ce refus, sans avoir besoin de justification compl\u00e9mentaire.<\/p>\n<p>Mais que se passe-t-il si le salari\u00e9 licenci\u00e9 sur ce fondement saisit le juge : ce dernier doit-il v\u00e9rifier le bienfond\u00e9 des objectifs contenus dans l\u2019accord ou peut-il se contenter d\u2019un contr\u00f4le formel de l\u2019accord ?<\/p>\n<p>Dans une affaire r\u00e9cente, un comptable a \u00e9t\u00e9 licenci\u00e9 apr\u00e8s avoir refus\u00e9 un changement de son lieu de travail, contenu dans un APC, visant \u00e0 centraliser les fonctions de comptabilit\u00e9.<\/p>\n<p>Sauf qu\u2019il saisit le juge pour contester le bienfond\u00e9 de son licenciement : selon lui l\u2019accord de performance collective, et la proposition de mobilit\u00e9 qu\u2019il contient, n\u2019est pas justifi\u00e9 par des contraintes li\u00e9es au fonctionnement de l\u2019entreprise.<\/p>\n<p>De ce fait, son refus ne peut pas mener \u00e0 son licenciement puisque les conditions de validit\u00e9 de cet accord collectif particulier ne sont pas remplies.<\/p>\n<p>\u00ab Faux ! \u00bb, conteste l\u2019employeur : la mobilit\u00e9 interne qui \u00e9tait impos\u00e9e au salari\u00e9 r\u00e9pondait bien \u00e0 un objectif strat\u00e9gique de d\u00e9veloppement de l\u2019activit\u00e9 et donc \u00e0 des n\u00e9cessit\u00e9s li\u00e9es au fonctionnement de l\u2019entreprise.
