D\u00e9duction faite de ses revenus ?<\/p>\n<div>\n<h2> Une indemnisation sans condition de revenus<\/h2>\n<p>Un salari\u00e9 saisit le juge afin d\u2019obtenir la r\u00e9siliation de son contrat de travail, produisant les effets d\u2019un licenciement abusif.<\/p>\n<p>L\u2019employeur y voit l\u00e0 un acte de d\u00e9loyaut\u00e9 du salari\u00e9 et le licencie pour faute lourde. Parce qu\u2019un tel licenciement porte atteinte \u00e0 la libert\u00e9 fondamentale qu\u2019est la libert\u00e9 d\u2019agir en justice, le juge le d\u00e9clare nul et ordonne \u00e0 l\u2019employeur d\u2019indemniser le salari\u00e9.<\/p>\n<p>Mais l\u2019employeur lui demande alors de justifier de ses ressources : il estime, en effet, que le salari\u00e9 dont le licenciement est nul ne peut \u00eatre indemnis\u00e9 que dans les limites du pr\u00e9judice qu&#8217;il a r\u00e9ellement subi et donc, sous d\u00e9duction des revenus \u00e9ventuellement per\u00e7us pendant la p\u00e9riode de son \u00e9viction.<\/p>\n<p>Non, lui r\u00e9pond le juge : il rappelle qu\u2019en cas de licenciement nul, lorsque le salari\u00e9 demande sa r\u00e9int\u00e9gration, il a droit au paiement d&#8217;une indemnit\u00e9 \u00e9gale au montant de la r\u00e9mun\u00e9ration qu&#8217;il aurait d\u00fb percevoir entre son \u00e9viction de l&#8217;entreprise et sa r\u00e9int\u00e9gration.
