Une r\u00e9paration qui peut prendre plusieurs formes, notamment dans le secteur du b\u00e2timent et de la construction\u2026<\/p>\n<h2>D\u00e9faut de construction\u202f: comment fixer la r\u00e9paration du pr\u00e9judice\u202f?<\/h2>\n<p>Apr\u00e8s l\u2019installation de panneaux solaires sur un b\u00e2timent de son exploitation, un agriculteur s\u2019aper\u00e7oit de probl\u00e8mes d\u2019infiltrations d\u2019eau sur sa toiture.<\/p>\n<p>Il demande alors \u00e0 \u00eatre indemnis\u00e9 financi\u00e8rement pour son pr\u00e9judice, mais l\u2019artisan qui a proc\u00e9d\u00e9 \u00e0 l\u2019installation pr\u00e9f\u00e8re une r\u00e9paration \u00ab\u202fen nature\u202f\u00bb du pr\u00e9judice\u202f: il propose de r\u00e9parer lui-m\u00eame les fuites.<\/p>\n<p>Ne pouvant se mettre d\u2019accord sur les modalit\u00e9s de r\u00e9parations du pr\u00e9judice, l\u2019agriculteur saisit la justice.<\/p>\n<p>Le juge va reconnaitre la responsabilit\u00e9 du professionnel ayant men\u00e9 \u00e0 la malfa\u00e7on, mais va n\u00e9anmoins privil\u00e9gier la solution d\u2019une r\u00e9paration en nature.<\/p>\n<p>Une d\u00e9cision que va contester l\u2019agriculteur\u202f: il tient \u00e0 son indemnisation financi\u00e8re.<\/p>\n<p>L\u2019agriculteur rappelle qu\u2019il est d\u2019admission constante pour le juge qu\u2019un professionnel, responsable d\u2019un d\u00e9faut de construction, ne puisse pas imposer \u00e0 son client une r\u00e9paration en nature.
