Voil\u00e0 l\u2019occasion de revenir sur les conditions subordonnant la mise en place d\u2019une telle surveillance\u2026<\/p>\n<h2>Vid\u00e9osurveillance en continu et logiciel de suivi des salari\u00e9s en t\u00e9l\u00e9travail\u202f: excessifs\u202f?<\/h2>\n<p>\u00c0 la suite d\u2019un contr\u00f4le cons\u00e9cutif \u00e0 des plaintes, la CNIL a prononc\u00e9 une amende de 40\u202f000 euros \u00e0 l\u2019encontre d\u2019une soci\u00e9t\u00e9 qui avait install\u00e9 sur les ordinateurs de certains salari\u00e9s un logiciel de suivi de leur activit\u00e9, dans le cadre du t\u00e9l\u00e9travail mis en place dans l\u2019entreprise.<\/p>\n<p>Autre point de blocage\u202f: la mise en place d\u2019un syst\u00e8me de vid\u00e9osurveillance dans l\u2019entreprise\u202fqui capturait le son et l\u2019image et \u00e9valuait les performances, en continu, des salari\u00e9s.<\/p>\n<p>Pour la CNIL, cette surveillance est excessive s\u2019agissant de la mesure du temps de travail et de la mesure de la performance des salari\u00e9s.<\/p>\n<p>Concernant la mesure du temps de travail, la CNIL reproche \u00e0 la soci\u00e9t\u00e9 d\u2019avoir param\u00e9tr\u00e9 le logiciel de mani\u00e8re \u00e0 pouvoir mesurer nominativement les temps qu\u2019elle consid\u00e9rait comme des temps d\u2019inactivit\u00e9.<\/p>\n<p>Ainsi, si le salari\u00e9 n\u2019effectuait aucune frappe sur le clavier ou mouvement sur la souris pendant un certain temps, ces temps d\u2019inactivit\u00e9 comptabilis\u00e9s pouvaient faire l\u2019objet d\u2019une retenue sur salarie, \u00e0 d\u00e9faut d\u2019\u00eatre justifi\u00e9s (ou rattrap\u00e9s) par les salari\u00e9s.<\/p>\n<p>Pour la CNIL, un tel dispositif ne permet pas un d\u00e9compte fiable des heures de travail contrairement \u00e0 la finalit\u00e9 annonc\u00e9e, puisque ces temps pouvaient \u00e9galement \u00eatre consacr\u00e9s \u00e0 des r\u00e9unions ou des appels t\u00e9l\u00e9phoniques professionnels par exemple, consid\u00e9r\u00e9s alors comme du temps de travail effectif.<\/p>\n<p>Concernant la mesure de la performance des salari\u00e9s, la CNIL constate que le logiciel permet d\u2019effectuer r\u00e9guli\u00e8rement des captures d\u2019\u00e9cran selon une r\u00e9currence d\u00e9termin\u00e9e individuellement par la soci\u00e9t\u00e9.<\/p>\n<p>Pour la CNIL, ce syst\u00e8me est particuli\u00e8rement intrusif en ce qu\u2019il peut conduire \u00e0 la capture d\u2019\u00e9l\u00e9ments d\u2019ordre priv\u00e9e (mots de passe ou conversation de messagerie instantan\u00e9e par exemple).<\/p>\n<p>La CNIL en conclut que l\u2019ensemble de ces \u00e9l\u00e9ments mis en place contrevient au RGPD et plus particuli\u00e8rement aux obligations suivantes\u202f:<\/p>\n<ul>\n<li>informer les personnes concern\u00e9es\u202f;<\/li>\n<li>assurer la s\u00e9curit\u00e9 des donn\u00e9es\u202f;<\/li>\n<li>r\u00e9aliser une analyse d\u2019impact relative \u00e0 la protection des donn\u00e9es pour les traitements mis en \u0153uvre.<\/li>\n<\/ul>\n<div>Sources :  <\/p>\n<ul>\n<li><a href=\"https:\/\/www.cnil.fr\/fr\/surveillance-excessive-des-salaries-sanction-de-40-000-euros-entreprise-secteur-immobilier\" rel=\"noopener\" target=\"_blank\">Actualit\u00e9 de la CNIL\u202f: \u00ab\u202fSurveillance excessive des salari\u00e9s\u202f: sanction de 40\u202f000 euros \u00e0 l\u2019encontre d\u2019une entreprise du secteur immobilier\u202f\u00bb<\/a><\/li>\n<\/ul>\n<\/div>\n<p><a href=\"https:\/\/www.weblex.fr\/weblex-actualite\/surveillance-des-salaries-attention-au-caractere-excessif\" target=\"_blank\">Surveillance des salari\u00e9s : attention au caract\u00e8re excessif \u202f! <\/a> &#8211; \u00a9 Copyright WebLex<\/p>\n<p><img decoding=\"async\" src=\"https:\/\/www.weblex.fr\/sites\/default\/files\/actualites\/images\/Shutterstock_surveillancesalaries.jpg\"><\/p>\n","protected":false},"excerpt":{"rendered":"<p>La commission nationale de l\u2019informatique et des libert\u00e9s (CNIL) a r\u00e9cemment sanctionn\u00e9 une entreprise en raison du caract\u00e8re disproportionn\u00e9 de la surveillance des salari\u00e9s.
