Cette exp\u00e9rimentation vient d\u2019\u00eatre prorog\u00e9e pour un nouveau d\u00e9lai de 4 ans, selon des modalit\u00e9s toutefois diff\u00e9rentes\u2026<\/p>\n<h2>CDIE\u202f: Une prolongation du dispositif pour 4 ans avec des param\u00e8tres diff\u00e9rents<\/h2>\n<p>Le contrat de travail \u00e0 temps partag\u00e9, tel qu\u2019initi\u00e9 par la loi \u00ab\u202favenir professionnel\u202f\u00bb depuis 2018, est un dispositif qui permet \u00e0 une entreprise de travail \u00e0 temps partag\u00e9 (ETTP) de proposer un contrat de travail \u00e0 temps partag\u00e9 \u00e0 des fins d\u2019employabilit\u00e9 (CDIE), sans avoir \u00e0 justifier d\u2019un cas de recours, \u00e0 des entreprises utilisatrices, qui ont du mal \u00e0 recruter en raison de leur taille et de leurs moyens.<\/p>\n<p>Introduit en 2018 \u00e0 titre exp\u00e9rimental, par la loi dite \u00ab\u202favenir professionnel\u202f\u00bb, ce contrat de mise \u00e0 disposition particulier entend faciliter l\u2019insertion sur le march\u00e9 du travail de demandeurs d\u2019emploi ou d\u2019actifs rencontrant des difficult\u00e9s d\u2019embauche particuli\u00e8res.<\/p>\n<p>Cens\u00e9 s\u2019achever le 31 d\u00e9cembre 2023, il vient juste d\u2019\u00eatre prorog\u00e9 pour une dur\u00e9e de 4 ann\u00e9es suppl\u00e9mentaire, selon des modalit\u00e9s am\u00e9nag\u00e9es.<\/p>\n<p>Ainsi, le public d\u00e9sormais \u00e9ligible au CDIE est plus restreint qu\u2019auparavant et vise\u202f:<\/p>\n<ul>\n<li>les demandeurs d\u2019emploi inscrit \u00e0 France Travail depuis 12 mois (contre 6 mois auparavant)\u202f;<\/li>\n<li>les demandeurs d\u2019emploi de 55 ans au moins inscrits \u00e0 France Travail depuis au moins 6 mois (et non plus les personnes \u00e2g\u00e9es d\u2019au moins 50 ans)\u202f;<\/li>\n<li>les personnes de moins de 26 ans ayant une formation de niveau inf\u00e9rieur ou \u00e9gal \u00e0 3 ann\u00e9es et qui sont inscrites comme demandeurs d\u2019emploi depuis au moins 6 mois (condition d\u2019\u00e2ge nouvelle)\u202f;<\/li>\n<li>les b\u00e9n\u00e9ficiaires de minima sociaux (inchang\u00e9)\u202f;<\/li>\n<li>les personnes handicap\u00e9es (inchang\u00e9).<\/li>\n<\/ul>\n<p>De plus, cette prorogation s\u2019accompagne \u00e9galement d\u2019un \u00e9largissement des droits des salari\u00e9s embauch\u00e9s via le CDIE, par l\u2019entreprise utilisatrice, se traduisant par\u202f:<\/p>\n<ul>\n<li>une absence de pr\u00e9avis, ne donnant pas lieu au versement d\u2019une indemnit\u00e9 compensatrice, dans le cas o\u00f9 le salari\u00e9 rompt son contrat de travail avec l\u2019ETTP, pour en conclure un nouveau avec l\u2019entreprise utilisatrice\u202f;<\/li>\n<li>une obligation de prise en compte la dur\u00e9e des missions accomplies chez elle au cours des 3 derniers mois, pour le calcul de l\u2019anciennet\u00e9 du salari\u00e9, en cas d\u2019embauche par l\u2019entreprise utilisatrice.<\/li>\n<\/ul>\n<p>Notez enfin que cette nouvelle version du CDIE est entr\u00e9e en vigueur le 15 novembre 2024.<\/p>\n<div>Sources :  <\/p>\n<ul>\n<li><a href=\"https:\/\/www.legifrance.gouv.fr\/jorf\/id\/JORFTEXT000050500471\" rel=\"noopener\" target=\"_blank\">Loi no 2024-1027 du 15 novembre 2024 visant \u00e0 poursuivre l\u2019exp\u00e9rimentation relative au travail \u00e0 temps partag\u00e9 aux fins d\u2019employabilit\u00e9<\/a><\/li>\n<\/ul>\n<\/div>\n<p><a href=\"https:\/\/www.weblex.fr\/weblex-actualite\/travail-a-temps-partage-aux-fins-d-employabilite-c-est-reparti\" target=\"_blank\" rel=\"noopener\">Travail \u00e0 temps partag\u00e9 aux fins d\u2019employabilit\u00e9 : c\u2019est reparti\u202f! <\/a> &#8211; \u00a9 Copyright WebLex<\/p>\n<p><img decoding=\"async\" src=\"https:\/\/www.weblex.fr\/sites\/default\/files\/actualites\/images\/Shutterstock_travailtempspartage.jpg\"><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Le contrat \u00e0 dur\u00e9e ind\u00e9termin\u00e9e aux fins d\u2019employabilit\u00e9 (CDIE) est un contrat de mise \u00e0 disposition particulier, facilitant l\u2019embauche d\u2019une population rencontrant des difficult\u00e9s d\u2019insertion sur le march\u00e9 du travail.
