Le licenciement est-il alors d\u00e9pourvu de cause r\u00e9elle et s\u00e9rieuse ou l\u2019employeur doit-il simplement verser des dommages int\u00e9r\u00eats au salari\u00e9\u202f? R\u00e9ponse du juge\u2026<\/p>\n<h2>Que se passe-t-il lorsqu\u2019un manquement de l\u2019employeur est \u00e0 l\u2019origine du licenciement\u202f?<\/h2>\n<p>Une analyste en information, exer\u00e7ant des fonctions de responsable, est licenci\u00e9e pour inaptitude par son employeur apr\u00e8s son burn-out et son impossibilit\u00e9 de reclassement.<\/p>\n<p>Sauf que la salari\u00e9e conteste le bienfond\u00e9 de son licenciement\u202f: selon elle, il serait d\u00e9pourvu de cause r\u00e9elle et s\u00e9rieuse dans la mesure o\u00f9 cette inaptitude est cons\u00e9cutive \u00e0 un manquement de l\u2019employeur \u00e0 ses obligations.<\/p>\n<p>Plus pr\u00e9cis\u00e9ment, elle lui reproche de ne pas avoir respect\u00e9 son obligation de s\u00e9curit\u00e9\u202f!
