Mais est-ce ici une obligation ?<\/p>\n<p class=\"MsoNormal\"><strong>Conseiller du salari\u00e9 en CDD : une protection sous conditions\u2026<\/strong><\/p>\n<p class=\"MsoNormal\">Un salari\u00e9 est embauch\u00e9 dans le cadre d\u2019un contrat \u00e0 dur\u00e9e d\u00e9termin\u00e9e \u00e0 temps partiel. Quelques temps plus tard, il est d\u00e9sign\u00e9 conseiller du salari\u00e9.&nbsp;<\/p>\n<p class=\"MsoNormal\">\u00c0 l\u2019issue de son CDD, qu\u2019il conteste, r\u00e9clamant sa requalification en CDI, il r\u00e9clame \u00e9galement des indemnit\u00e9s au titre de la violation de son statut protecteur : puisqu\u2019il a \u00e9t\u00e9 d\u00e9sign\u00e9 conseiller du salari\u00e9, il estime que l&#8217;arriv\u00e9e du terme du CDD n&#8217;entra\u00eene sa rupture qu&#8217;apr\u00e8s constatation par l&#8217;inspecteur du travail que le salari\u00e9 ne fait pas l&#8217;objet d&#8217;une mesure discriminatoire.<\/p>\n<p class=\"MsoNormal\">Mais l\u2019employeur conteste cette analyse : pour lui, cette r\u00e8gle ne vaut que dans le seul cas d&#8217;un CDD saisonnier ou d&#8217;usage, pr\u00e9voyant une clause de reconduction.<\/p>\n<p class=\"MsoNormal\">Une analyse qui est pr\u00e9cis\u00e9e par le juge qui rappelle la r\u00e8gle applicable : la rupture du CDD d&#8217;un conseiller du salari\u00e9 avant l&#8217;\u00e9ch\u00e9ance du terme en raison d&#8217;une faute grave ou de l&#8217;inaptitude constat\u00e9e par le m\u00e9decin du travail, ou \u00e0 l&#8217;arriv\u00e9e du terme lorsque l&#8217;employeur n&#8217;envisage pas de renouveler un contrat comportant une clause de renouvellement, ne peut intervenir qu&#8217;apr\u00e8s autorisation de l&#8217;inspecteur du travail.<\/p>\n<p class=\"MsoNormal\">\u00c0 contrario, il n&#8217;y a pas lieu de saisir l&#8217;inspecteur du travail dans le cas de l&#8217;arriv\u00e9e du terme d&#8217;un CDD ne relevant pas des contrats saisonniers ou d\u2019usage et ne comportant pas de clause de renouvellement.<br \/>Fort de ce rappel, le juge donne ici raison \u00e0 l\u2019employeur\u2026<\/p>\n<div>Sources :  <\/p>\n<ul>\n<li><a href=\"https:\/\/www.legifrance.gouv.fr\/juri\/id\/JURITEXT000049989201?init=true&amp;page=1&amp;query=22-21856&amp;searchField=ALL&amp;tab_selection=all\" rel=\"noopener\" target=\"_blank\">Arr\u00eat de la Cour de cassation, chambre sociale, du 10 juillet 2024, n\u00b0 22-21856<\/a><\/li>\n<\/ul>\n<\/div>\n<p><a href=\"https:\/\/www.weblex.fr\/weblex-actualite\/salarie-protege-en-cdd-un-statut-particulier\" target=\"_blank\" rel=\"noopener\">Salari\u00e9 prot\u00e9g\u00e9 en CDD : un statut particulier ?<\/a> &#8211; \u00a9 Copyright WebLex<\/p>\n<p><img decoding=\"async\" src=\"https:\/\/www.weblex.fr\/sites\/default\/files\/actualites\/images\/Shutterstock_cdd_statut_particulier.jpg\"><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Un salari\u00e9, embauch\u00e9 en CDD, est d\u00e9sign\u00e9 conseiller du salari\u00e9.
