Dont les modalit\u00e9s pratiques viennent d\u2019\u00eatre pr\u00e9cis\u00e9es\u2026<\/p>\n<h2>Recul du trait de c\u00f4te et droit de pr\u00e9emption : des modalit\u00e9s pr\u00e9cis\u00e9es<\/h2>\n<p>Mis en place dans le cadre de la politique de recomposition territoriale, impact\u00e9e par l\u2019\u00e9rosion, ce nouveau de pr\u00e9emption permet d&#8217;acqu\u00e9rir des biens situ\u00e9s dans les zones expos\u00e9es au recul du trait de c\u00f4te, en vue d&#8217;en assurer la renaturation avant leur disparition, et de pouvoir \u00e9ventuellement autoriser \u00e0 titre temporaire un usage ou une activit\u00e9 compatible avec son niveau d&#8217;exposition.<\/p>\n<p>Ce droit de pr\u00e9emption peut trouver \u00e0 s&#8217;appliquer dans des zones expos\u00e9es \u00e0 horizon 0-30 ans et 30-100 ans qui couvrent \u00e9galement des espaces agricoles sur lesquels le droit de pr\u00e9emption des soci\u00e9t\u00e9s d&#8217;am\u00e9nagement foncier et d&#8217;\u00e9tablissement rural (SAFER) est \u00e9galement applicable (mais ce droit de pr\u00e9emption \u00ab recul du trait de c\u00f4te \u00bb prime le droit de pr\u00e9emption des SAFER).<\/p>\n<p>La d\u00e9lib\u00e9ration par laquelle le conseil municipal ou l&#8217;organe d\u00e9lib\u00e9rant de l&#8217;\u00e9tablissement public de coop\u00e9ration intercommunale comp\u00e9tent d\u00e9cide d&#8217;instaurer le droit de pr\u00e9emption pour l&#8217;adaptation des territoires au recul du trait de c\u00f4te est affich\u00e9e en mairie pendant un mois et mention en est faite dans deux journaux diffus\u00e9s dans le d\u00e9partement.<\/p>\n<p>Si le propri\u00e9taire d\u2019un bien soumis \u00e0 ce droit de pr\u00e9emption manifeste son intention d\u2019ali\u00e9ner, il doit le faire en \u00e9tablissant une d\u00e9claration adress\u00e9e en 3 exemplaires \u00e0 la mairie de la commune o\u00f9 se trouve le bien, par lettre recommand\u00e9e avec demande d&#8217;avis de r\u00e9ception, ou d\u00e9pos\u00e9e contre d\u00e9charge, ou adress\u00e9e par voie \u00e9lectronique en 1 seul exemplaire.<\/p>\n<p>Le titulaire du droit de pr\u00e9emption peut demander \u00e0 visiter le bien et, lorsqu&#8217;elle est accept\u00e9e, la visite du bien se d\u00e9roule dans le d\u00e9lai de quinze jours calendaires \u00e0 compter de la date de la r\u00e9ception de la r\u00e9ponse du propri\u00e9taire, en dehors des samedis, dimanches et jours f\u00e9ri\u00e9s.<br \/>&nbsp;<\/p>\n<div>Sources :  <\/p>\n<ul>\n<li><a href=\"https:\/\/www.legifrance.gouv.fr\/jorf\/id\/JORFTEXT000049832808\" rel=\"noopener\" target=\"_blank\">D\u00e9cret n\u00b0 2024-638 du 27 juin 2024 relatif aux modalit\u00e9s d&#8217;application du droit de pr\u00e9emption pour l&#8217;adaptation des territoires au recul du trait de c\u00f4te<\/a><\/li>\n<\/ul>\n<\/div>\n<p><a href=\"https:\/\/www.weblex.fr\/weblex-actualite\/erosion-cotiere-un-nouveau-droit-de-preemption\" target=\"_blank\" rel=\"noopener\">Erosion c\u00f4ti\u00e8re : un nouveau droit de pr\u00e9emption<\/a> &#8211; \u00a9 Copyright WebLex<\/p>\n<p><img decoding=\"async\" src=\"https:\/\/www.weblex.fr\/sites\/default\/files\/actualites\/images\/Shutterstock_droit_preemption_erosion_cotiere.jpg\"><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Pour favoriser la relocalisation progressive de l&#8217;habitat et des activit\u00e9s impos\u00e9e par le ph\u00e9nom\u00e8ne de recul du trait de c\u00f4te, un nouveau droit de pr\u00e9emption propre \u00e0 l&#8217;adaptation des territoires expos\u00e9s au recul du trait de c\u00f4te a \u00e9t\u00e9 mis en place.
