L\u2019assistance par le salari\u00e9 de ses coll\u00e8gues lors d\u2019entretiens pr\u00e9alables en pr\u00e9sence de l\u2019employeur suffit-elle \u00e0 consid\u00e9rer qu\u2019il a connaissance du mandat ? R\u00e9ponse du juge\u2026<\/p>\n<h2>L\u2019assistance \u00e0 l\u2019entretien pr\u00e9alable = preuve suffisante ?<\/h2>\n<p>Le salari\u00e9 d\u2019une association, engag\u00e9 en qualit\u00e9 de r\u00e9gisseur, est licenci\u00e9 pour faute grave.<\/p>\n<p>Sauf qu\u2019il conteste ce licenciement en rappelant qu\u2019il est \u00ab conseiller du salari\u00e9 \u00bb, ce qui lui conf\u00e8re le statut \u00ab de salari\u00e9 prot\u00e9g\u00e9 \u00bb et qui oblige son employeur \u00e0 solliciter une autorisation administrative avant de prononcer son licenciement. Proc\u00e9dure qu\u2019il n\u2019a pas respect\u00e9e ici, invalidant son licenciement\u2026<\/p>\n<p>Il rappelle d\u2019ailleurs que son employeur savait qu\u2019il \u00e9tait titulaire d\u2019un tel mandat externe parce que, au-del\u00e0 des formalit\u00e9s administratives, le salari\u00e9 avait d\u00e9j\u00e0 assist\u00e9 pr\u00e9alablement une de ses coll\u00e8gues lors de son entretien pr\u00e9alable.<\/p>\n<p>Mais l\u2019employeur s\u2019en d\u00e9fend : il n\u2019avait pas connaissance de l\u2019exercice de ce mandat externe par le salari\u00e9, rappelant au passage que, lors d\u2019un entretien pr\u00e9alable, un salari\u00e9 peut se faire assister par toute personne de son choix appartenant \u00e0 l\u2019entreprise, sans que cette personne soit n\u00e9cessairement \u00ab conseiller du salari\u00e9 \u00bb.<\/p>\n<p>Il rappelle que, pour se pr\u00e9valoir de la protection r\u00e9sultant d\u2019un mandat ext\u00e9rieur, le salari\u00e9 doit en informer son employeur, au plus tard lors de l\u2019entretien pr\u00e9alable, ce qui n\u2019a pas \u00e9t\u00e9 fait ici.<\/p>\n<p>En outre, la pr\u00e9sence du salari\u00e9 \u00e0 l\u2019entretien pr\u00e9alable d\u2019une coll\u00e8gue ne saurait d\u00e9montrer, \u00e0 elle seule, que l\u2019employeur avait connaissance de l\u2019exercice du mandat par le salari\u00e9.<\/p>\n<p>\u00ab Tout \u00e0 fait \u00bb, tranche le juge en faveur de l\u2019employeur : la protection attach\u00e9e \u00e0 l\u2019exercice d\u2019un mandat externe par le salari\u00e9 est subordonn\u00e9e \u00e0 une information pr\u00e9alable de l\u2019employeur qui ne saurait se d\u00e9duire de la seule assistance du salari\u00e9 \u00e0 ses coll\u00e8gues lors de leur entretien pr\u00e9alable.<\/p>\n<p>L\u2019employeur, qui n\u2019a pas \u00e9t\u00e9 d\u00fbment inform\u00e9, ne peut pas se voir reprocher l\u2019irrespect de la proc\u00e9dure de licenciement particuli\u00e8re applicable aux salari\u00e9s prot\u00e9g\u00e9s.<\/p>\n<div>Sources :  <\/p>\n<ul>\n<li><a href=\"https:\/\/www.legifrance.gouv.fr\/juri\/id\/JURITEXT000049641068?init=true&amp;page=1&amp;query=23-10753&amp;searchField=ALL&amp;tab_selection=all\" rel=\"noopener\" target=\"_blank\">Arr\u00eat de la Cour de cassation, chambre sociale, du 29 mai 2024, no 23-10753<\/a><\/li>\n<\/ul>\n<\/div>\n<p><a href=\"https:\/\/www.weblex.fr\/weblex-actualite\/un-salarie-protege-c-est-un-employeur-informe\" target=\"_blank\" rel=\"noopener\">Salari\u00e9 prot\u00e9g\u00e9 = employeur inform\u00e9 !<\/a> &#8211; \u00a9 Copyright WebLex<\/p>\n<p><img decoding=\"async\" src=\"https:\/\/www.weblex.fr\/sites\/default\/files\/actualites\/images\/conseillerdusalarie.jpg\"><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Parce que le mandat de conseiller du salari\u00e9 est un mandat externe \u00e0 l\u2019entreprise, le b\u00e9n\u00e9fice du statut protecteur suppose que l\u2019employeur en soit inform\u00e9.
