Une fronti\u00e8re qui n\u2019est pas toujours si simple que cela \u00e0 appr\u00e9cier en pratique\u2026<\/p>\n<h2>Changement des conditions de travail : faut-il un accord du salari\u00e9 ?<\/h2>\n<p>Un salari\u00e9 est employ\u00e9 en qualit\u00e9 d\u2019agent de maintenance polyvalent et de concierge, partiellement de nuit, aux termes d\u2019un contrat qui stipule qu&#8217;il pouvait \u00eatre demand\u00e9 au salari\u00e9 l&#8217;ex\u00e9cution de toute autre t\u00e2che relevant de sa cat\u00e9gorie d&#8217;emploi, sans que cela constitue une modification de son contrat de travail.<\/p>\n<p>L\u2019employeur, interpr\u00e9tant le contrat de travail en ce sens, d\u00e9cide de lui confier, en plus de son activit\u00e9 de conciergerie une activit\u00e9 de nettoyage et de travaux divers.
